Section 12 in Bureau of Indian Standards (Conformity Assessment) Regulations, 2018

12. Application for grant of certificate of conformity.

(1)If demonstration of conformity is desired without the use of Standard Mark, an application may be made for grant of certificate of conformity under section 13 to the Bureau in the form specified in the applicable conformity assessment scheme in Schedule II.
(2)The processes involved in grant of certificate of conformity and fee shall be as specified in the applicable conformity assessment scheme in Schedule-II.
(3)On receipt of application under sub-regulation (1), the Bureau may make enquires for verification of the particulars set out in the application and also such other enquiries as it may deem necessary.
(4)The Bureau may ask the applicant or its authorised representative to appear before it for personal representation before the grant of certificate of conformity.
(5)An application which is not complete in all respects or does not conform to the requirements of sub-regulations (1) and (2) shall be rejected by the Bureau:Provided that, before rejecting an application, the applicant shall be given an opportunity to remove, within thirty days of the date of receipt of relevant communication from the Bureau, such objections as may be indicated by the Bureau:Provided further that the Bureau may, on sufficient reason being shown, extend the time for removal of objections by such further time, not exceeding thirty days, as the Bureau may consider fit to enable the applicant to remove such objections:Provided also that the Bureau shall, give a reasonable opportunity to the applicant of being heard, either in person or through a representative authorised by him in this behalf, and may take into consideration any fact or explanation furnished by the applicant or his representative, as the case may be.
