(5)Where the appointment of a polling agent is revoked under sub-rule (1) or where the polling agent dies before the close of the poll, the candidate or his election agent may, at any time before the poll is closed, appoint a new polling agent in accordance with the provisions of sub-rule (1) of Rule 42 ;Provided that the letter appointing new polling agent shall-(a)in the case where such appointment is made not less than seven days before the commencement of the poll be given to the Returning Officer; and(b)in any other case, be given to the Returning Officer or the Presiding Officer of the polling station where the new polling agent is appointed.
