3. This application is filed on behalf of the Plaintiff under Section 12-A of the Commercial Courts Act, 2015 read with Section 151 CPC seeking exemption from Pre-Institution Mediation.
4. Having regard to the facts of the present case wherein urgent relief is prayed for and in light of the judgment of Supreme Court in Yamini Manohar v. T.K.D. Keerthi, (2024) 5 SCC 815, as also Division Bench of this Court in Chandra Kishore Chaurasia v. RA Perfumery Works Private Ltd., 2022 SCC OnLine Del 3529, exemption is granted to the Plaintiff from Pre-Institution Mediation.

10. Upon filing of process fee, issue summons to the Defendants through all permissible modes, returnable before the learned Joint Registrar on 06.04.2026.
11. Summons shall state that the written statements shall be filed by the Defendants within 30 days from the receipt of summons along with affidavits of admission/denial of the documents filed by the Plaintiff.
12. It will be open to the Plaintiff to file replications within 30 days from the date of receipt of written statements along with affidavit of admission/denial of documents filed by the Defendants.
13. If any of the parties wish to seek inspection of any documents, the same be sought and given the timeline prescribed in Delhi High Court (Original Side) Rules, 2018.

17. Case of the Plaintiff as set out in the plaint is that the Plaintiff is a prominent digital house of brands catering to the diverse needs of millennial customers and was established in 2019. From natural personal care to science-backed skincare and a modern take on Ayurveda, each of its brands has a unique proposition and is created for millennials.
18. It is stated that trademark BELLAVITA, was first adopted by the Predecessor of the Plaintiff, under which it started selling beauty care and perfumery products. After the Plaintiff took over the business it diversified into all segments of Beauty & Personal Care Industry. Plaintiff, also known as Group IDAM is a house of FMCG brands backed by Private Equity Investment and the vision of the company with its portfolio brands is to be a conscious and conscientious partner in all walks of life to all demographics and genders through all their ages and stages of lifecycles. In July, 2021, Plaintiff, which is a collective of various direct-to-consumer (D2C) FMCG and beauty and personal care brands, raised funding of $10 million from various investors and since then, it has acquired brands across cosmetics, skincare, makeup, nutraceuticals and food & beverages.
19. It is stated that Plaintiff boasts of Bella Vita Organic, Brave Essentials, Bella Vita Luxury as major brands and other brands acquired/created and managed by the Plaintiff through its group companies are BEVZILLA and Thriveco, amongst others. At present, Plaintiff is exploring luxury Ayurveda brands, health food brands and nutraceutical brands to acquire. 20. It is stated that Plaintiff has a dedicated website https://www.bellavitaorganic.com, where it provides information about the BELLAVITA brand and products marketed thereunder. Website also lists Plaintiff's product 'WHITE OUD' and is accessible from anywhere in the world. Screenshots from the website are reproduced below:-

21. It is stated that Plaintiff has devoted substantial resources to the development and promotion of its brands and is very active on social networking sites such as Instagram and Facebook, whereby Plaintiff interactively engages with consumers and the mainstream public alike. Social media platforms of the Plaintiff have large number of followers, which further establishes its fame and reputation amongst the general public.
22. It is stated that Plaintiff is the owner and proprietor of the trademark/ brand name BELLAVITA and markets and sells various perfumery products under the same. Plaintiff has launched a whole range of perfumery products under BELLAVITA umbrella, all of which have been carefully crafted and created keeping in mind the customer taste and approach. Few such products as launched, marketed and sold under the trademark/brand name are 'BELLA VITA WHITE OUD/ WHITE OUD', 'BELLA VITA HONEY OUD/ HONEY OUD' 'BELLA VITA SKAI AQUATIC/SKAI AQUATIC' 'BELLA VITA IMPACT MAN/IMPACT MAN', 'BELLA VITA ROSE WOMAN/ROSE WOMAN', 'BELLA VITA GLAM WOMAN/GLAM CS(COMM) 211/2026 Page 5 of 14 This is a digitally signed order.

One such series of products has been the 'OUD' series and includes products such as BELLAVITA OUD, WHITE OUD and HONEY OUD. Products of Plaintiff under the said brand were first launched and put to use by the Plaintiff in the market in 2021.
23. It is stated that Plaintiff's BELLAVITA is one of the most trustworthy personal care brands in India and offers the best-in-class beauty and personal products to help the consumers discover the essence of beauty with the goodness of nature. Plaintiff is a consumer-oriented organization and customer's complete satisfaction and safety is its ulterior motive. Brand BELLAVITA has been promoted by the Plaintiff through various endorsements in major events and by major celebrities. Plaintiff is also one of the major sponsors of a highly viewed reality show 'BIGG BOSS', which is aired on major satellite and OTT platforms. Plaintiff has also launched several categories and variants of its perfumes and other beauty care products under the BELLAVITA brand, which are sold in unique packaging as follows:-

24. It is stated that the packaging/trade dress of the bottles is distinctive and unique and constitutes 'original artistic work' in the form of shapes, shades and colour combinations of the bottles and caps for different variants of the products. The trade dress has been designed and created by the Plaintiff within the organization after extensive market research about consumer taste and adaptability and Plaintiff is the owner of copyright of the artistic work under the Copyright Act, 1957 and thus entitled to statutory protection from infringement.
25. It is stated that Plaintiff is the registered proprietor of the trademark BELLAVITA and its variants in India and the registrations are valid and subsisting. The trademarks BELLAVITA/BELLAVITA LUXURY are also registered in various other countries such as United Kingdom, Chile, WIPO, African Intellectual Property Organization (OAPI) (including territories of Gabon, Cameroon, Republic of Congo, Central Africa Republic, Ivory Coast, Senegal, Mali, Mauritania Chad, Togo, Benin, Burkina-Faso, Guinea, Guinea Bissau, Niger, Equatorial Guinea and Comoros), Malaysia and Singapore. 26. It is stated that Plaintiff extensively advertises its trademarks including the products under the trademark 'BELLAVITA' and its variants, which are being sold under the unique packaging and trade dress and has spent substantial amounts of money in widely advertising its products in print and electronic media. Due to extensive advertising and excellence in service, the turnover of Plaintiff has been on the rise over the years and the details of the sales made by Plaintiff from the years 2020-2024 are as follows:-
27. It is stated that recently Plaintiff came across infringing products under the trademark 'OUD WHITE' being manufactured and sold by Defendants No. l to 3, which is visually and phonetically similar to Plaintiff's trademark 'WHITE OUD'. In addition, Defendants have slavishly copied the trade dress of Plaintiff's product sold under its trademark 'WHITE OUD' including the white-coloured glass bottle with a golden cap for 100 ML and 20 ML bottles, in entirety. Defendants have also copied the placement of the brand name, container shape and size of the product. The impugned products are being sold all over the country including Delhi, on Defendants' own websites as also other e-commerce platforms. 28. It is stated that Plaintiff sent a cease-and-desist notice dated 10.07.2025 to Defendant No. 1, informing about the prior adoption and usage of the trademark/trade dress and asking it to refrain from selling the impugned products, bearing the deceptively similar trademark OUD WHITE and virtually identical trade dress for its products, in response to which Defendant No. 1 declined to stop the illegal activities. Defendant No. 1 also opposed the trademark applications of the Plaintiff for trademark WHITE OUD.
29. It is stated that it has also come to the knowledge of the Plaintiff that in addition to the impugned product OUD WHITE, Defendants are also CS(COMM) 211/2026 Page 10 of 14 This is a digitally signed order.

30. Learned counsel for the Plaintiff submits that Plaintiff is the owner of artistic works in trade dress/labels/packaging of its products sold and marketed under the brands BELLAVITA and its different product range/variants, including and not limited to product sold under the mark WHITE OUD. By imitating and copying the labels/trade dress/packaging, Defendants are infringing Plaintiff's copyright, despite a statutory protection in favour of the Plaintiff. It is evident that the intent of the Defendants in copying the exact trade dress/labels/packaging/bottle shapes to sell their CS(COMM) 211/2026 Page 11 of 14 This is a digitally signed order.

The Order is downloaded from the DHC Server on 16/03/2026 at 20:52:21 products is to misrepresent to the public that they have some connection with the Plaintiff only with a view to ride on the formidable reputation and goodwill, which it has built over the years and thus, Defendants are guilty of passing off.
31. Plaintiff has registrations in the trademarks BELLAVITA and its formative marks, which includes WHITE OUD. The original artistic work in the labels/packaging/trade dress is designed by the Plaintiff within its organization, in which copyright vests in favour of the Plaintiff. From the comparative tables hereinabove, it can be seen that Defendants have attempted to come as close as possible to Plaintiff's labels/packaging/trade dress in terms of the shapes of the bottles, colour combinations as also the caps. Prima facie the imitation is with the view to ride over the immense reputation and goodwill of the Plaintiff by representing an association or connection of the Defendants with the Plaintiff, which is resulting in irreparable injury to the Plaintiff, amounting to passing off and copyright infringement. The rival marks OUD WHITE and WHITE OUD are deceptively similar and the impugned packaging/trade dresses are deceptively similar to those of the Plaintiff and the consumer base and trade channels are common. Seen holistically, there is every likelihood of confusion amongst the consumers and members of the trade, if Defendants continue to sell the impugned products under the impugned trade dresses/labels/packaging.
32. Having heard learned counsel for the Plaintiff and upon perusal of the documents, I am of the view that Plaintiff has made out a prima facie for grant of ex parte ad interim injunction against the Defendants. Balance of convenience lies in favour of the Plaintiff and it is likely to suffer irreparable harm in case the interim injunction, as prayed for, is not granted.

33. Accordingly, till the next date of hearing, Defendants, their principals, proprietor, partners, officers, employees, agents, distributors, suppliers, affiliates, subsidiaries, franchisees, licensees, representatives, group companies and assigns are restrained from:-
a) using the trademark/name OUD WHITE and/or any other trademark or name identical and/or deceptively similar to Plaintiff's trademark WHITE OUD and/or BELLAVITA WHITE OUD either as a trademark or part of a trademark, a trade name or corporate name or as a part of a domain name, email Id, Social media profile name or in any other manner whatsoever, so as to constitute passing off of the impugned products of the Defendants as those of the Plaintiff;
b) manufacturing or authorizing the manufacture, marketing, distributing, exporting, selling, offering for sale of any product bearing labels/packaging/trade dress/bottle shape identical or deceptively similar to the trade dress of Plaintiff's products being marketed and sold under the trademarks WHITE OUD/BELLAVITA WHITE OUD in respect of its range of perfumes, amounting to infringement of copyright of the Plaintiff;
c) manufacturing or authorizing the manufacture, distributing, exporting, selling, offering for sale, advertising, promoting, displaying and/or using, in any manner whatsoever, products bearing labels/packaging/trade dress/bottle shape, identical or deceptively similar to variants of Plaintiff's products under its 'BELLAVITA' range of perfumes, as brought forth in paragraph 29 above, amounting to infringement of copyright and passing off.CS(COMM) 211/2026 Page 13 of 14
