Background

1. The Applicant filed his RTI application on 31.08.09 with the Additional Secretary, Medical Council of India, New Delhi seeking information against 5 points related to registered Medical Practitioners taking kick backs/commissions from diagnostic centers/pathological laboratories and action taken against such Medical Practitioners . The PIO replied on 25.09.09 enclosing copy of the Indian Medical Council (Professional Conduct, Etiquette and Ethics) Regulations, 2002 to the Applicant. Not satisfied with the reply, the Applicant filed an appeal on 30.10.09. The Secretary, MCI replied on 25.11.09 enclosing again a copy of the MCI regulations, 2002. Being aggrieved with this reply, the Applicant filed a Complaint before the Commission on 02.01.2010.

2. The Bench of Mrs. Annapurna Dixit, Information Commissioner scheduled the hearing for 25th March, 2010.

3. Dr. Davinder kumar, Deputy Secretary cum PIO and Mr. J S Bhasin, Advocate represented the Public Authority.

4. The Complainant was present during the hearing.

Decision

5. On perusal of the RTI application the Commission noted that the Appellant had not sought any information as defined under Section 2(f) of the RTI Act and has sought the PIO's opinions on the issue of Medical Practitioners taking kickbacks/commissions. Information available on record (ie. Regulations 2002) have been provided to the Complainant. The Appellant is hence advised to seek specific information available in the records of the Public Authority.

6. The appeal is accordingly disposed of.
