W.P.(CRL) 982/2023 By way of the present petition under Article 226 of the Constitution of India read with section 482 of the Code of Criminal Procedure 1973, the petitioner prays for transfer of the investigation in FIR No.30/2023 dated 24.01.2023 registered under sections 376D/376/354C/506/34 of the Indian Penal Code, 1860 and sections 27/54/59 of the Arms Act, 1959 at P.S.: Ghazipur filed by her, to some other police station or investigating unit, on the allegation that the investigation is not being conducted in accordance with law.

2. The petitioner also seeks an order directing the DCP, East District to provide protection to the petitioner.

3. Mr. Jai S. Thakur, learned counsel appearing for the petitioner submits that the Investigating Officer has been remiss in investigating and pursuing the matter before the learned Trial Court, which is the essence of the grievance.

5. Mr. Sanjeev Bhandari, learned ASC appears on behalf of respondents Nos. 1 to 3 on advance copy; accepts notice; and seeks time to file status report.

6. Let status report be filed within 04 weeks; response thereto, if any, be filed within 03 weeks thereafter; with copies to the opposing counsel.
