ORDER

Rule.

Learned APP Shri J.K.Shah waives service of notice of Rule.

The present application has been moved by the petitioner through jail seeking his release on temporary bail on the ground that he having been convicted by the Sessions Court for the offence under Section 376, he would like to file appeal before the High Court and there is nobody in his family to take necessary action for filing appeal before the High Court.

Having regard to the report of the jail authorities, it appears that the petitioner was convicted for the offence under Section 376 of Indian Penal Code and was sentenced to undergo rigorous imprisonment for a period of ten years by the Sessions Court at Anand. It also appears that earlier the petitioner had moved an application seeking his release on parole for enabling him to file appeal before the High Court and the said application was rejected by this Court on 28th March, 2011. Having regard to the said remarks of the jail authorities, the present application also deserves to be dismissed and is accordingly dismissed.
