Ramesh Ranganathan, CJ. (Oral) This appeal is preferred against the order passed by the learned Single Judge in Writ Petition (S/S) No. 2238 of 2016 dated 27.03.2017.

The respondent herein filed the said writ petition seeking a writ of certiorari to quash the office order dated 27.07.2016 issued by the fifth respondent; to declare her as not working in the same post after . declaring that her resignation dated 22.01.2016 is deemed to have been accepted w.e.f. 22.01.2016 from her earlier post of Assistant Teacher at Primary School, Dharpangu, Dharchula in Pithoragarh district; for a writ of mandamus commanding the respondents to decide the representation dated 23.08.2016 by a speaking order; and
- for a writ of mandamus commanding respondent nos. 5 and 6 to allow her to work during the pendency of the writ petition.

The learned Single Judge has, in the order under appeal, observed that the respondent-writ petitioner was appointed as an Assistant Teacher on a regular basis; she joined duty at the Primary School, Dharpangu, Dharchula on 14.10.2016; she was a single parent taking care of her daughter at Dharchula; taking into consideration, .
Po. oles Mgt Ao ae Ete 7 sg Bgihd utile optic cole ce. dow eae | Mat "path Ey on 22.01.2016; thereafter, she again participated in the selection process to the post of Assistant Teacher; on her selection, she joined duty at the Primary School, Block Narsan, Roorkee, District Haridwar; her services were terminated by the impugned order dated 27.07.2016; she was neither issued any show cause notice, nor was she afforded any opportunity of being heard before passing the order . dated 27.07.2016; she, being a permanent government servant, ought to have been afforded an opportunity of being heard before passing the impugned termination order dated 27.07.2016; the purported ground, on which the respondent-writ petitioner's services were terminated by the impugned order, is that she had concealed the fact of her earlier appointment; she was legitimately expecting that the resignation tendered by her on 22.01.2016 would be accepted within a reasonable period; the respondents have taken an unduly long period in rejecting the resignation dated 22.01.2016 made by her; there was no concealment per se in the present case; there was also violation of principles of natural justice; and the action of the respondents, in terminating the services of the petitioner without following principles of natural justice, was a nullity.
4, The learned Single Judge, thereafter, observed that the resignation of the respondent-writ petitioner should have been accepted in view of the peculiar facts and circumstances of the case.
The writ petition was allowed and the order dated 16.11.2016, QO 4 a. § LL.
