ORAL ORDER
5 29-11-20221. All these writ petitions were tagged together as there's a common grievance in all the writ petitions that the salary is not being released of the petitioners. In some cases, the petitioners were appointed after orders passed by the District Appellate Authority and State Appellate Authority. Petitioners Patna High Court CWJC No.22186 of 2019(5) dt.29-11-2022 41/45 counsels have submitted that while the petitioners are working regularly, their salary has been withheld without giving any reasons. The Additional Chief Secretary was therefore called to explain as to why the salary is being withheld.
2. The Additional Chief Secretary vide his circular dated 08.07.2022 has passed following order addressed to all the District Education Officers and the District Programme Officers Establishment:-

3. From the perusal of above, it is apparent that the respective nodal officers have a responsibility to see that salary of the teachers is not withheld. If there is any delinquency committed by any of the teacher, the provisions of CCA Rules, 2005 have to be applied. He may be suspended or departmental enquiry be initiated against him. However, there is no scope for Patna High Court CWJC No.22186 of 2019(5) dt.29-11-2022 42/45 stopping the salary of a person who is working. The same would amount to begar in terms of Article 23(2) of the Constitution of India and would be a deprivation of his Fundamental Right. In view thereof, the action of the respondent in withholding the salary of the petitioners is held to be illegal and arbitrary exercise of power.
4. Learned counsels for the petitioners have informed that several of them have been paid some part of their salary after the orders passed by the Additional Chief Secretary Education (supra). However, still the arrears of salary have not been released.
5. Learned counsels appearing for the State submit that there are cases where the teachers absentee certificate has not been forwarded by the concerned school or by the employment unit. It is also stated that certificate regarding recognition of the degree has also not been forwarded.
6. In the opinion of this Court, certification regarding recognition of degree is a question altogether foreign to the payment of salary. If any persons degree or educational qualifications are required to be verified, the exercise has to be conducted by the department itself. For the said purpose, the concerned teacher cannot be denied his salary. The judgment of Patna High Court CWJC No.22186 of 2019(5) dt.29-11-2022 43/45 the Supreme Court has already been cited by the Additional Chief Secretary in his circular (supra). Thus, excuses of want of verification of educational qualifications cannot be accepted to deny salary to the teachers.
7. Even if a criminal case has been registered, unless a charge-sheet has been filed, it cannot be said that criminal case is pending against a teacher. It is only under scrutiny by the investigating authority. On that count too, salary of a teacher cannot be withheld. However, if subsequently it is found that forgery has been committed or appointment has been obtained by fraudulent means, the entire salary can be recovered from the concerned individuals apart from other actions to be taken against him.
8. Keeping in view above, it is directed that the salary of the teachers shall not be withheld on excuses as above and arrears of salary shall also be released. Fund in this regard shall be made available by the Education Department to the concerned employment units for the purpose of payment. It is made clear that if the arrears are not released within a stipulated period of four months from today, the teachers would be entitled to receive interest on the arrears of the amount of salary at the rate of nine per cent. The interest amount shall be recoverable Patna High Court CWJC No.22186 of 2019(5) dt.29-11-2022 44/45 from the respective District Education Officers/District Programme Establishment Officer.
9. If the salary/arrears of salary are not released, the concerned teacher would also be entitled to file an appeal before the respective District Appellate Authority. If such an appeal is preferred, the same shall be decided expeditiously within a period of three months. If required, the District Appellate Authority/State Appellate Authority would be also empowered to impose penalty in terms of Rule 16 of the Rules of 2020 which provides as under:
"16. Power to impose Punishment:-
In case of non-compliance of the order/direction or in case of any complaints by the party for compliance of the order:-
(i) The Appellate Authority shall impose punishment against-concerned party but he will be given adequate opportunity of hearing before imposing punishment.
(ii) The Appellate Authority may impose penalty upto Rs. 50,0001/- (Fifty thousand only) upon the answerable party. The amount of penalty shall be deposited in the Treasury under the head indicated by the Department. The amount of penalty shall be recoverable by way of Public demand.
(iii) The Appellate Authority shall have jurisdiction to make recommendation to the concerned Department to initiate Departmental proceeding or to take necessary action against the delinquent employee under the provisions of Bihar Service Code/Bihar Panchayat Raj Act 2006/Bihar Municipal Act 2007 and other relevant provisions."
10. Any individual grievance still pending or not redressed can be taken up before the concerned District Patna High Court CWJC No.22186 of 2019(5) dt.29-11-2022 45/45 Appellate Authority/State Appellate Authority by filing an appeal.
11.With aforesaid directions, all writ petitions stands disposed of.
