(Per: HONOURABLE MR. JUSTICE SHIVAJI PANDEY)

3 29-01-2020

Heard learned counsel for the petitioner and learned counsel for the Union of India.

At the time of hearing, counsel for the petitioner has made a limited prayer that though he has not right over the post in which he has worked as a substitute of his brother as his brother was working in the Postal Department, he was sent on deputation to Army Postal Service where he has finally been absorbed, now the Authority has decided to fill up the vacant post in regular manner, however, counsel for the petitioner submits that he has no grievance, if the vacancy is filled up in a Patna High Court CWJC No.25004 of 2018(3) dt.29-01-2020 2/2 regular manner, but he has worked for 16 years, his experience should be taken into consideration at the time of selection.

If the petitioner applies for that post, the Authority while making recruitment will consider his experience in accordance with law.

With this observations and directions, this writ application stands disposed of.
