The grievance of the petitioners is that despite these petitioners having rendered regular service for a continuous period in excess of ten years, their services have not been regularised. The petitioners say that even under the relevant notification issued by the State, the petitioners were eligible for regularisation.

At least in one similar matter an order was passed for the Gorkha Teritorial Administration to take appropriate steps in accordance with law.

The State is represented and it is submitted that the State is not averse to a procedure for regularisation being formulated in consultation with the GTA, subject to the condition that the petitioners should otherwise be eligible for the posts on the basis of the criteria applicable thereto in the usual course.

Since the petitioners are agreeable to the suggestion of the State, W.P.10510 (W) of 2015 is disposed of by directing the State to convene a meeting with the GTA, whereat any two representatives of the petitioners will be invited to attend, for the purpose of deciding the matter as to regularisation of the services of the petitioners and others similarly placed.

The exercise should be completed within a period of four months from date.

There will be no order as to costs.

Certified website copies of the order, if applied for, be urgently made available to the parties, subject to compliance with all requisite formalities.
