Section 28 in Calcutta Port Act, 1890

28. Acts or proceedings or Commissioners not to be invalidated in consequence of vacancy.-

(1)No act or proceeding of the Commissioners shall be invalidated or illegal in consequence only of there being a vacancy in the number of the Commissioners at the time of doing or executing such act or proceeding.
(2)Proceedings not to be in validated by informality in election or appointment.- All proceedings of the Commissioners, or of any person acting as a Commissioner in the bona fide belief that he was duly elected or appointed, shall, notwithstanding it be afterwards discovered that there was some defect in the election or appointment of the Commissioner or person acting as aforesaid, be as valid as if every such person had been duly elected or appointed to be a Commissioner.
