(Per : HONOURABLE MR.JUSTICE JAYANT PATEL) The present application is for condonation of delay of 36 days in preferring First Appeal against the Judgement and Order dated 30.09.2009 passed by the Civil Court in Special Civil Suit No.37/02.
Heard Mr.Bhatt for the applicant, Ms.Vasavada has filed affidavit for service of respondent No.2. Respondent No.2 is served, but none appears.
Considering the facts and circumstances and in view of the grounds stated in the application for condonation of delay, sufficient cause is made out. Hence, delay deserves to be condoned and therefore, condoned.
Application allowed to the aforesaid extent. Rule made absolute accordingly.
First Appeal to be listed for hearing on 30.08.2010.
