PRESENT Mr.Prashant Sethi, Advocate, for the appellant.
M.M.S. BEDI, J. (ORAL)
The parties had got an agreed order from the Family Court on 14.5.2018, pertaining to the custody of the minor child Prince.
The present appeal has been filed by the wife alleging that the agreed order is being violated and is not being adhered in its true letter and spirit.
We have heard the counsel for the appellant and are of the opinion that the appeal does not lie against an agreed order and we find that in case there is any grievance of the appellant regarding the implementation of the agreed order, it is always open to the appellant to approach the same Court as the provision of Section 43 of the Guardian and Wards Act, deal with the regulation of the conduct or the proceedings of the guardians and enforcement of the orders passed under the Act.
Disposed of with the above said liberty.
