On the question whether the issue that Proceedings under section 12 of the Domestic Violence Act, 2005 pending before Magistrate's Court can be transferred to a Family Court be referred to a Larger Bench, arguments of Mr.Sarwate, Ms.Irani, Mr.Jagtap and Mr.Deshmukh, learned counsel have been concluded.
2. Mr.Cama at the outset would point out that the decision of this court in the case of Suyash Ashokkumar Singhania Vs. Varsha Suyash Singhania and anr. being Criminal Application No.146 of 2021 dated 8 th July, 2022 has been quashed and set aside by order dated 7 th August, 2023 of the Hon'ble Supreme Court of India in Criminal Appeal No.... of 2023 arising out of SLP CRL No.12557 of 2002.
3. Mr.Cama has substantially concluded his arguments. For Mr.Cama to conclude his arguments and for the other counsel also to make their submissions, list on 6th October, 2023 at 2.30 p.m. as well as on 7 th October, Priya R.
