Section 17(1) in The Bengal Agricultural Debtors Act, 1936
(1)An Application under section 8 may be dismissed by the Board, at any stage of its proceedings, in respect of all or any of the debts to which it relates,-(a)if, for reasons to be stated in writing, the Board does not consider it desirable or practicable to effect a settlement of debts, or(b)if, in the opinion of the Board-(i)the applicant fails to pursue his application with due diligence, or(ii)the debtor is attempting to use the provisions of this Act with a view to defraud any creditor or any person referred to in clause (d) of sub-section (1) of section 11.
