               Dated this the 7th day of April, 2014

                             JUDGMENT

The petitioners have approached this Court with the following prayer:-

"(i) Issue a writ of mandamus or any other appropriate writ or order commanding the respondents to collect motor vehicle tax from the petitioners one month tax for their respective vehicles on the strength of Exthibit.P2 circular in the event of the petitioners offering to pay 1/3rd (one month) Tax at the time of entry into the State of Kerala."

2. The learned counsel for the petitioners submits that, by virtue of Ext.P2 Circular dated 23.11.1991 issued by the first respondent, it is always open for the petitioner to have the tax remitted in the manner as sought for herein. It is also brought to the notice of this Court that, exactly similar issue was considered by this Court and a decision has been rendered in favour of the petitioner as per the decision rendered in Balan v. State of Kerala [2004 (1) KLT 479].

3. Heard the learned Government Pleader as well. W.P.(C)No.9388 of 2014 2

4. After hearing both the sides and also after going through the pleadings and materials on record, this Court finds that the petitioners are entitled to succeed.

In the above circumstances, this writ petition is disposed of, with a direction to the respondents to accept the motor vehicle tax from the petitioners, provided all other conditions for such acceptance are fully complied with, at the earliest.

The petitioner shall produce a copy of this judgment along with a copy of the writ petition before the concerned respondent for further steps.
