Learned advocate for the petitioner submits that the petitioner is helper of a truck who has been falsely implicated in connection with the instant case on the accusation of recovery of 5,000 bottles of phensedyl and is in custody since 26th June, 2025. Petitioner further submits that in the meantime two of the co- accused have been granted bail in CRM(NDPS)1738 of 2025.
Learned advocate for the State submits that the bail of the consigner and the consignee has been granted in CRM (NDPS) 1738 of 2025 on 29.12.2025.
I have taken into account the locus of the persons who have been granted bail and the petitioner is one allegedly from whose possession recovery has been made. There may be other persons involved.
2Having considered the rigors of Section 37 of the NDPS Act, I am not inclined to release the petitioner on bail at this stage when the charge-sheet has been submitted before the learned trial court.
Accordingly, CRM(NDPS) 50 of 2026 is dismissed. Learned advocate for the petitioner complains that entire documents on which the prosecution proposes to rely has not been supplied.
Learned special court would assess such contention being advanced by the petitioner. If there are cryptically any documents left out for being supplied, learned special court would ensure such process being carried out.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
