ORAL ORDER

41 24-12-2021Re.: I.A. No. 01 of 2021 in CWJC No. 8341 of 2021 Learned counsel points out that the objection of the applicants/claimants and other land owners is pending consideration with the authority concerned since the year 2019.
Our order dated 23.07.2021 is evidently clear. The authorities are duty bound to decide the objections expeditiously and in accordance with law. In view of the grievances vented out by the applicants, without going into the correctness thereof, we direct the appropriate authority to positively decide the applicants' claim/objections pending consideration, if any, Patna High Court CWJC No.8093 of 2019(41) dt.24-12-2021 17/19 within a period of three months from today.
However, we clarify that pendency of such application/claim/objection would not preclude the authorities in either taking over possession or demolishing the structures, as already directed in terms of our order dated 23.07.2021.
At this stage, Shri Prashant Kumar, learned counsel for the applicants/ claimants states that claimants have no intent of obstructing the possession being taken or the structure being demolished. In fact, the applicants would themselves surrender the possession, if not already done and the structure can be removed. They undertake to such effect.
Statement accepted and taken on record. Parties through the learned counsel be made aware of the consequences of breach of undertakings for any breach would entail, we would not hesitate to initiate proceeding for contempt if anyone of the land owners obstruct the process of taking over of possession or removal of structure on the road.
Application stands disposed of in the aforesaid terms.
Needless to add, all contentions raised by the applicants shall be dealt with by the appropriate authority. Singh, learned Assistant Solicitor General; Shri Kumar Priya Ranjan, learned Central Government Counsel; Shri Anjani Kumar, learned Additional Advocate General No. 4; Shri S.D. Sanjay, learned Senior Counsel; Shri Anshay Bahadur Mathur, learned counsel; Mr. Gautam Kumar Kejriwal, learned counsel, Mr. Pawan Kumar, learned Assistant Counsel to learned Advocate General; Shri Siddharth Prasad/Shri Ramadhar Shekhar, learned counsel for the Railways, and Mr. Anand Kumar Ojha, learned counsel.
We have also perused the status with respect to each one of the Highways in a format prepared by the State.
Shri Anjani Kumar, learned AAG-4 rightly points out that the information furnished needs to be verified and updated.
Let this exercise be completed positively within next ten days.
In fact, we request Shri Anjani Kumar to hand over copy of the excel sheet containing such information to the learned senior counsel for the N.H.A.I. for ascertaining the factual position.
Patna High Court CWJC No.8093 of 2019(41) dt.24-12-2021 19/19 We further request such information to be verified by all the respective stakeholders.
Shri Atul Sharma, learned counsel for the contractor in CWJC No. 8357 of 2021, states that orders dated 04.08.2021 and 09.08.2021 have not yet complied with.
In response, Shri Siddharth Prasad, learned counsel who appears for the Railways, states that the affidavit indicating the latest status report shall be filed before the next date of hearing. We also request the learned counsel for the N.H.A.I. to file an affidavit with respect to said project.
We have invited attention of Shri Anjani Kumar with respect to certain other roads for which information needs to be furnished.
