Section 40 in The Darjeeling Gorkha Hill Council Act, 1988
40. Discharge of functions. -
(1)The executive functions of the General Council shall vest in the Executive Council.(2)All orders or instruments made or executed by the Executive Council shall be deemed to have been made or executed by or under the authority of the General Council. Every such order or instrument shall be authenticated by the signature of the head of the Executive Council or [any other Executive Councillor] [Words substituted by W.B. Act 3 of 1994.] or by any officer of the Executive Council authorised in writing by the head of the Executive Council in this behalf.
