This is the second petition filed by the petitioner for the grant of regular bail, the first one having been dismissed on 20.2.2014.
As per the prosecution, the petitioner and his co-accused, who was later on identified to be Buta Singh was going on a motor-cycle at a high speed towards village Nagri on the canal bank. There was one branch of the tree, which had fallen on the bank of the river and the motor-cycle, on which the petitioner and his co-accused were travelling dashed against the same. As a result thereof, they fell on the ground. The petitioner, who was driving the motor-cycle sat down at the spot as he had received injuries. His co-accused Buta Singh, who was sitting on the rear seat, fled away through fields after discarding a small bag carried by Asija Vijay 2014.07.02 12:05 I attest to the accuracy and integrity of this document High Court,Chandigarh Criminal Misc. The search of the bag which fell from the motor-cycle led to recovery of 35 kilograms of poppy husk, whereas from the bag, which was discarded by Buta Singh, co-accused of the petitioner, 1300 tablets, which had Diphenoxylate hydrochloride as its active ingredient, were taken into possession.
After obtaining instructions from ASI Lakhwinder Singh, learned State counsel has informed the Court that apart from the present case the petitioner is involved in one more case i.e. FIR No.13 dated 1.2.2010, under Section 15 of the NDPS Act, registered at Police Station Siwan, District Kaithal.
Keeping in view the quantity of the contraband recovered from the petitioner as well as bag discarded by co-accused of the petitioner while running away and the fact that the petitioner is involved in one more case under the provisions of NDPS Act, no ground is made out for grant of bail to the petitioner.
The petition is, accordingly, dismissed.
