Prayer:
Petition filed under Article 226 of the Constitution of India to
issue a Writ of Certiorarified Mandamus calling for the records of
second respondent in connection with impugned orders passed by him
in (i) Na.Ka.No.12638/B1/2023-20 dated 24.07.2023; (ii) Na.Ka.No.
12638/B1/2023-32 dated 24.07.2023 (iii) Na.Ka.No.12638/B1/2023-
17 dated 24.07.2023; (iv) Na.Ka.No.12638/B1/2023-34 dated

respondents to restore seniority of the petitioners at par with those
who were selected and appointed as Fireman and sent for training on
22.07.2001 and fix the seniority in the cadre of Fireman based on the
marks secured by them in the process of selection made by the third
respondent and grant them all consequential services and monetary
benefits.

ORDER
The petitioners have filed this writ petition seeking to quash 2/6 https://www.mhc.tn.gov.in/judis ( Uploaded on: 02/01/2026 01:47:12 pm ) W.P.No.186 of 2024 the orders passed by the second respondent dated 24.07.2023 and to direct the respondents to restore seniority of the petitioners on par with those who were selected and appointed as Fireman and sent for training on 22.07.2001 and fix the seniority in the cadre of Fireman based on the marks secured by them in the process of selection made by the third respondent and grant them all consequential services and monetary benefits.
2.The learned Senior Counsel appearing for the petitioners submitted that the petitioners entered service as directly recruited Fireman through the selection conducted by TNUSRB during the year 1999 – 2000 and were appointed to service on 01.12.2002 and after institutional training were posted to serve in various stations throughout Tamilnadu and were upgraded as Leading Fireman on completion of 15 years of service. Even though, the selection list was published during the year 2000, the petitioners were given appointment only during the year 2002. Hence, the petitioners’ claimed to restore their seniority on par with those who were selected and appointed as Fireman and sent for training on 22.07.2001 and to fix the seniority in the cadre of Fireman based on the marks secured by them in the process of selection made by the third respondent and 3/6 https://www.mhc.tn.gov.in/judis ( Uploaded on: 02/01/2026 01:47:12 pm ) W.P.No.186 of 2024 to grant all consequential service and monetary benefits, however, the same was rejected by the respondents.
3.The learned Senior Counsel appearing for the petitioners further submitted that in paragraph no.11 of the counter affidavit filed by the second respondent, it is stated that as per orders issued in G.O.Ms.No.179, Home (Police-17) Department, dated 20.03.2019 the Government issued necessary orders by amending the rule relates to Tamil Nadu Fire and Rescue Sub-ordinate Services in respect of fixing seniority and granting promotion to the posts covered under the above rule and as per the existing rule promotions are made only based on the Enlistment and State Seniority. Based on the above orders, the second respondent has already revised and fixed the State seniority of the personnel who have been appointed through the third respondent from the year 1996 as per the third respondent merit list. Hence, this Court may without going into the merits of the case, grant liberty to the petitioners to challenge the seniority list fixed by the respondents 2 and 3.
4.Considering the limited relief now sought for by the learned Senior Counsel appearing for the petitioners, this Court without 4/6 https://www.mhc.tn.gov.in/judis ( Uploaded on: 02/01/2026 01:47:12 pm ) W.P.No.186 of 2024 expressing any opinion on the merits of the case, grant liberty to the petitioners to challenge the seniority list fixed by the respondents 2 and 3, if so advised.
