Mr. Ashis Kumar Chowdhury Ms. Indrani Patra ... for the petitioner Dr. Sutanu Kumar Patra ... for the WBSSC Mr. Subrata Ghosh Mr. Raja Ram Banerjee ... for the State This is an application under Article 226 of the Constitution of India wherein the writ petitioner is aggrieved by the fact that counseling process is proposed to be started by the West Bengal School Service Commission without publishing the panel on their website. It is his case that the West Bengal School Service Commission (Selection for Appointment to the post of Teachers for Classes XI and XII in Higher Secondary Schools) Rules, 2016 (hereinafter referred to as the 'said Rules') require the Commission to first publish the final merit list and only thereafter to conduct the counseling process.
Dr. Patra, appearing on behalf of the West Bengal School Service Commission fairly submits, that the legal position enunciated by the counsel on behalf of the petitioner is correct and publication of the merit list is mandated by the Rules.
2In view of the above submission made on behalf of the counsel on behalf of the parties, I direct the West Bengal School Service Commission to start the counseling process after three days of publishing the merit list as per the rules.
Nothing remains in this writ petition. Therefore, the same is disposed of with the above direction.
No order as to costs.
Since no affidavit is called for, the allegations made in the writ petition are deemed to have been denied.
