JUSTICE SABINA Order 09/05/2017 Petitioners have filed this second petition under Section 439 Code of Criminal Procedure, 1973 seeking regular bail in F.I.R. No. 26/2017 registered at Police Station Thoi, Distt. Sikar, for offences under Sections 353, 186, 379 of Indian Penal Code, 1860 & Sections 32, 33 of Rajasthan Forest Act, 1953 Learned counsel for the petitioners has submitted that the petitioners are in custody since 19.04.2017. It is a case of no injury. Challan has already been presented in the Court and conclusion of trial may take time. Petitioners are not involved in any other criminal case.

(2 of 2) [CRLMB-6209/2017] Learned State Counsel on the other hand has opposed the petition.

Keeping in view the facts and circumstances of the case, it would be just and expedient to order the release of the petitioners on bail.

Accordingly, without expressing any opinion on merits of the case, this petition is allowed. Petitioners be admitted to bail subject to satisfaction of the Trial Court.
