ORDER
1. The Appellant filed an RTI application dated 29.08.2022 seeking information on the following points:
(i) "Copy of minutes of review committee showing the reasons recorded in connection with the extension of suspension for another 180 days vide SPO's Bardoli Division order in Memo No. B1/Suspension/GMP/2/2019 dated 20.12.2019.Page 1 of 3
(ii) Names of Members of Review committee.
(iii) Name of Place where Review meeting held. (If held online then copy of recording
of online meeting.)"
2. The CPIO replied vide letter dated 05.09.2022 and the same is reproduced as under:-
i. "Copy of minutes of review committee dated 17.06.2022 is attached herewith. ii. Name of members of review committee is mentioned in the copy of minutes attached. iii. The required information does not fall under the Section 2(f) of RTI Act, 2005.
Hence the same cannot be provided."
3. Dissatisfied with the response received from the CPIO, the Appellant filed a First Appeal dated 17.09.2022 alleging that the information provided was incomplete, false and misleading. The FAA vide order dated 17.10.2022 directed the CPIO to furnish the information to the Appellant. In compliance of the FAA's order dated 17.10.2022, the CPIO replied vide letter dated 21.10.2022 and provided the information on point no. (iii) of the RTI Application i.e. venue of meeting was Office of Director, PTC, Vadodara.
4. The appellant and on behalf of the respondent Shri Arvind Kumar, Superintendent of Posts and CPIO, Bardoli Division, attended the hearing through video conference.
5. The appellant inter alia submitted that he had received the revised reply and had no further plea before the Commission.
6. The respondent while defending their case inter alia submitted that they had provided remaining information on point no. (iii) of the RTI application vide letter dated 21.10.2022.
7. The Commission after adverting to the facts and circumstances of the case, hearing both parties and perusal of records, observed that the respondent had duly complied with the FAA's order dated 17.10.2022 and provided the requisite information to the appellant vide letter dated 21.10.2022. The Appellant, during the course of hearing, acknowledged the receipt of the aforementioned revised reply dated 21.10.2022 and requested the Page 2 of 3 Commission that his second appeal may be closed. Accordingly, the appeal is dismissed as withdrawn.
Copy of the decision be provided free of cost to the parties.
