ORDER:

Heard the learned counsel for the petitioner, the learned Government Pleader for Social Welfare and the learned Government Pleader for Land Acquisition for respondents. With their consent, the Writ Petition is disposed of at the stage of admission itself.

The main grievance of the petitioner in this Writ Petition is that the authorities are not considering the application made by the petitioner on 29.11.2011 for re-determination of compensation.

Learned counsel for the petitioner has stated that in respect of the very same notification, the adjacent land owners have been awarded enhanced compensation by the competent Civil Court. Therefore, the learned counsel seeks a direction from this Court to get the same benefit extended to the petitioner also.

Learned Government Pleader, on instructions, has stated that due to various administrative exigencies, the pandemic situation prevailing in the Country and the subsequent lockdown, the official respondents could not consider the application made by the petitioner on 29.11.2011 and requests this Court to grant some time to pass necessary orders thereon.

In view of the above made submissions, the writ petition is disposed of directing the respondent No.3-Land Acquisition Officer to consider the application/petition, dated 29.10.2011, submitted by the petitioner under Section 28 (A) of the Land Acquisition Act, seeking re-determination of the compensation and pass necessary 2 orders thereon, as expeditiously as possible, preferably, within a period of eight weeks from the date of receipt of a copy of this order, strictly in accordance with the law. It is needless to mention that before passing any orders, the petitioner shall be put on notice and afforded an opportunity of hearing. A copy of the order passed by the respondents shall be communicated to the petitioner.

The miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
