1. At the outset, Mr. Dutta, learned counsel appearing on behalf of the decree holders (DHs) submits that due to an inadvertent typographical error, his appearance has not been marked in the last order. Learned counsel for the JD confirms the fact that Mr. Dutta, had appeared on the last date. Accordingly, it is clarified that Mr.Dutta had appeared before the Court on behalf of the DHs on 13.07.2020.
2. Vide the present petition under Section 36 of the Arbitration and Conciliation Act, 1996 ('the Act') the DHs are seeking enforcement of arbitral award dated 31.10.2017 whereunder their primary claim, which has been allowed, is for return of the title deed in respect of property bearing No.B-25, Qutub Institutional Area, New Delhi - 110016. It transpires that after the present petition was adjourned on 13.07.2020, the JD had preferred a petition under Section 9 of the Act being OMP (I) (COMM.) 199/2020 which was listed before HMJ C. Hari Shankar, who had, vide order dated 22.07.2020, directed that status quo be maintained qua the aforesaid title deed and that the same would be retained by the Registry of this Court during the pendency of those proceedings.
3. In these circumstances, it would be appropriate that the present petition be also listed before the same bench. List before HMJ C. Hari Shankar, subject to the orders of Hon'ble the Judge Incharge (Original Side) on 31.07.2020.
