ORDER
Hon'ble Mr. R.N. Singh, Member (J):
With the consent of learned counsels for the parties, the aforesaid OAs were heard together at length on 8.5.2025, the factual matrix of the cases and arguments advanced by the respective learned counsels were also recorded. However, due to paucity of time, the final order could not be passed and accordingly, the OAs were reserved for orders. As the factual matrix and arguments advanced by the learned counsels for the parties were recorded at length, paras 1 to 19 thereof are reproduced as hereunder:-

1. Learned counsels for the parties have agreed that the applicants in the aforesaid O.As are similarly placed they have sought similar relief on common grounds and accordingly with their consent all the captioned O.As have been heard together and are being disposed of by the present common order.
2. At the request of the learned counsels for the parties, O.A. No. 3750/2022 has been treated as the lead case and accordingly facts are being taken for writing of this order from the said O.A.
3. The applicants have prayed for the following reliefs in O.A. No. 3750/2022 :-40 OA Nos.3750 of 2022, 3730/2022,
156/2023 & 1082/2023 "(a) stay and quash the impugned order dated 01.12.2022 passed by respondent no. 2 in the interest of justice.
(b) direct the respondents to implement the order dated 03.05.2021 issued by Ministry of Health & Family Welfare and to grant benefits thereof especially preference and regularization of the services of the applicants; and
(c) continue and extend the services of the applicants from time to time till their services are regularized as per order dated 03.05.2021."

The learned counsel for the applicant in the above lead case submits, under instructions that he is not pressing the prayer seeking regularisation with liberty to the applicants to agitate the same separately in accordance with law. Learned counsel for the applicants submits that the direction to the respondents for regularization of the services of the applicants has been prayed for in the O.A., however, under instructions, he is not pressing the same with liberty to the applicants to seek such relief before the appropriate forum under the Industrial Disputes Act, 1947. Learned counsel for the applicants in the other O.As have categorically stated that they have not prayed for regularization in their respective O.As and liberty may be left with them, to agitate the same, if they are so advised separately in accordance with law. Accordingly, prayer for regularisation stands dismissed as not pressed with liberty to the applicants in accordance with law in this regard.
5. We have heard the learned counsels for the parties and with their assistance have perused the pleadings on record and have also gone through the judgments referred and relied by them.41 OA Nos.3750 of 2022, 3730/2022,

It is undisputed that Ministry of Health and Family Welfare, Government of India, keeping in view the situation arising out of Covid 19 pandemic, issued various direction to all the States and Union Territories for appointment of medical staff during the period of Covid-19 pandemic. One such scheme was issued vide O.M./circular dated 03.05.2021. Pursuant to such scheme the respondents herein issued notice dated 18.06.2021 (Annexure A/2 Colly.) inviting applications from eligible candidates to fill up the vacant posts of Pharmacist (tenure of 89 days only) on ad-hoc basis to manage 500 ICU bed facility at Ram Leela Maidan, New Delhi.

The respondents issued various notice(s) for various posts from time to time during that period and in response thereto, the applicants participated in the selection process and on being found eligible and suitable, were appointed on various paramedical posts by the respondents and since their such appointment they have been continuing as such and performing to the entire satisfaction of the authorities concerned amongst the respondents. However, abruptly, the respondents issued the impugned order dated 01.12.2022 (Annexure A/1) vide which it was ordered that no further extension is to be granted by the competent authority beyond 31.12.2022 and the services of the paramedical staffs as per the list enclosed with such impugned notice to be discontinued w.e.f. 01.01.2023 (F/N) without any further notice. Aggrieved by the notice dated 01.12.2022, the applicants have approached this Tribunal and this Tribunal vide interim order dated 21.12.2022 directed the respondents not to discontinue the services of the applicants till the next date of hearing. Such interim order was continued from time to time and the same is still continuing.

Learned counsels for the applicants during pendency of the O.A. and even today have submitted that though in view of the interim order(s) passed by this Tribunal in the captioned O.As, the applicants are continuing on the respective posts, however, they are not being paid salary regularly. Mr. Amit Anand, learned counsel for the respondents, under 42 OA Nos.3750 of 2022, 3730/2022, 156/2023 & 1082/2023 instructions from the officers present today from the office of the respondents has submitted that all the applicants shall be paid their admissible dues/salary, perks etc., within 4 weeks, if the same have not been paid to any one of them.

Learned counsels for the applicants have argued that the post against which the applicants were engaged are sanctioned post(s) and/or the work against which the applicants have been engaged and are continuing are work of perennial nature. The respondents have passed order dated 01.12.2022 only to deprive the applicants from their lawful claim of regularization and/or their further continuation against such post(s)/work in order to enable the respondents to fill up the post being held by the applicants by contractual employees through outsourcing agency, through retired persons on ad- hoc and/or contractual basis and/or juniors or freshers. By the impugned order(s) and action(s), the respondents have also attempted to deprive the applicants from being considered for grant of concessions as notified by the Government of India through their aforesaid circular dated 03.05.2021.
10. Learned counsel for the applicants, Mr. Anuj Aggarwal has argued that such impugned order and action of the respondents is contrary to the law settled on the subject. He argues that all the applicants have not only shouldered the responsibilities during hard time by taking risk to their life and means but they were also selected keeping in view their eligibility and suitability by the competent authority amongst the respondents. In this background, learned counsel for the applicants submits that the applicants are entitled to be continued on the post/work for which they are appointed till the post/work against which the applicants were appointed is filled up through regular selection process and during regular selection process the applicants are entitled to be given preference some additional weightage in the light of the Government of India decision notified vide their aforesaid circular dated 03.05.2021.

11. In support of such claim of the applicants, the learned counsel for the applicants has placed reliance on a common order/judgment dated 22.12.2023 of this Tribunal in O.A. No. 509/2022 with a batch of O.As. He has also placed reliance on order/judgment dated 06.02.2023 of Chandigarh Bench of this Tribunal in O.A. No. 060/1103/2022 and an order/judgment dated 18.01.2024 of a Co- ordinate Bench of the Principal Bench of the Tribunal in O.A. No. 2633/2021.
12. On the other hand, Mr. Amit Anand, learned counsel for the respondents has vehemently opposed the claim made by the applicants. He has argued that the applicants were engaged keeping in view the emergent situation arising out of Covid-19 pandemic, and they were not engaged against any sanctioned regular post(s). He further submits that the engagement of the applicants was initially for tenure of 89 days only and keeping in view the condition that prevailed during the relevant time, the engagement of the applicants was extended further. He further invites our attention to various conditions incorporated in the notice for such appointments and submits that it was already made known to the applicants that candidates so appointed shall not claim for permanent post/regularization against the post and age relaxation in lieu of this temporary assignment. By referring to the averments made in the counter reply, he submits that while making such arrangement/appointment of the applicant(s), the relevant recruitment rules were followed, in as much as, only the educational qualification was considered and not the age criteria and/or any other normal test or interview was also not conducted. He further submits, under instructions from the officer(s) present from the office of the respondents that the advertisement/notice which has been referred to by the applicants in the above O.A.(s) to indicate that the respondents were in the process of engaging a new set of contractual/daily wage employees against the work and post on which the applicants have been working and continuing has been kept in abeyance. He further submits that as the respondents have found that at present, situation 44 OA Nos.3750 of 2022, 3730/2022, 156/2023 & 1082/2023 is not the same as was during the period when the applicants were appointed, this Tribunal may not direct the respondents to continue the applicants any further.
13. In support of his such arguments he has placed reliance on the judgment of the Hon'ble Apex Court in Union of India and Ors. ,etc., Vs. Tejram Parashramji Bombhate and Ors. reported in 1992 AIR 570, wherein it is held by the Hon'ble Apex Court that "No court or the Tribunal could compel the Government to change its policy involving expenditure. The Tribunal, therefore, could not have issued the directions as it did to compel the Central Government to assess the needs of the school and create the necessary posts without support of law"

In rejoinder, learned counsel for the applicant has referred to various internal notes and communications of the respondents to indicate that adequate work is available under the respondents against which the applicants have been engaged and are still continuing. He has also referred to certain notes and the documents wherein recommendations have been made by certain authorities amongst the respondents to post adequate number of employees against the work/post on which the applicants have been engaged and are still continuing. He submits that the applicants were engaged against the vacant posts and such vacant posts are still available with the respondents. He submits that even at this stage, the respondents have stated that the decision taken by them to fill up the vacant posts through outsourcing agency has been put in abeyance and such decision of the respondents has since not been withdrawn.
15. From the aforesaid, the undisputed facts, as noted hereinabove, are that the applicants were selected to meet the urgent need of the respondents arising out of the Covid-19 Pandemic. They met the educational qualification/skill for the relevant post(s). Their satisfactory performance is also not disputed by the respondents. It is undisputed that the respondents have issued order/notice for filling 45 OA Nos.3750 of 2022, 3730/2022, 156/2023 & 1082/2023 up such posts through outsourcing agency on ad- hoc/contractual basis. However, such notice/circular has been kept in abeyance by the respondents but the same has not been withdrawn.

In view of the aforesaid facts and circumstances, the issue arises (i) as to whether once the applicants have been engaged directly by the competent authority amongst the respondents in terms of their specific scheme, they can be replaced by another set of daily wagers/contractual employees directly and/or through outsourcing agency or not? (ii) as to whether while filling up the aforesaid relevant posts on regular basis the respondents are required to consider grant of certain age relaxation/preference to the applicants over others in the light of their notified circular dated 03.05.2021 referred to hereinabove.
17. The aforesaid circular dated 03.05.2021 reads as under:-
"To, Additional Chief Secretary/Principal Secretary Health/Medical education All States/UTs Subject: Augmenting Human resources for COVID - 19 - regarding.
Madam/Sir, In view of the need for increasing the availability of trained human resources to tackle the Covid-19 pandemic situation, the following Guidelines are being issued in consultation with the National Medical Commission and the Indian Nursing Council.
I -RELAXATION/FACILITATION/EXTENSION
1. Considering the current situation in the wake of resurgence of COVID - 19, National Eligibility cum Entrance Test-NEET (PG) - 2021 is being postponed. This Exam will not be held before 31st August 2021. At least one-month time will be given after the announcement of the Examination before it is 46 OA Nos.3750 of 2022, 3730/2022, 156/2023 & 1082/2023 conducted. The State/UT Governments are to make all efforts to reach out to each such prospective NEET candidate and persuade them to join the Covid
- 19 workforce in this hour of need. The services of these MBBS doctors can be utilized in the management of COVID - 19.
2. The State/UT Governments may deploy Medical Interns in Covid Management duties under the supervision of their faculty, as part of the Internship rotation.
3. The services of Final Year MBBS students can be utilized for providing services like tele-consultation and monitoring of mild Covid cases after due orientation by and supervision of Faculty.
4. The services of Final Year PG Students (broad as well as super-specialities) as residents may continue to be utilized until fresh batches of PG Students have joined. Likewise, the services of the senior residents / registrars may continue to be utilized until new recruitments are made.
5. B.Sc./GNM Qualified Nurses may be utilized in full-time Covid nursing duties in ICU, etc., under the supervision of Senior Doctors and Nurses.
6. Final Year GNM or B.Sc. (Nursing) students awaiting Final Exam may be given full time Covid Nursing duties at Government/Private facilities under the supervision of Senior Faculty.
7. The services of Allied Health Care professionals may be utilized for assistance in Covid Management, based on their training and certification.
8. The additional human resources thus mobilized should be used only in facilities managing Covid.
II - INCENTIVES/ RECOGNITION OF SERVICE
9.Health is a State subject and human resources for health are largely engaged by State Governments. The Central Government engages for their own institutions. The private sector also engages a large number of Health professionals.47 OA Nos.3750 of 2022, 3730/2022,

10.The relaxation mentioned above, finalized in consultation with the National Medical Commission and the Indian Nursing Council, is to further augment human resources for responding to Covid- 19 and should be fully availed by public and private institutions engaged in the effort.
11. The National Health Mission (NHM) norm for contractual human resource engagement by States/UTs may be considered for implementation of the above proposed initiative for engaging additional manpower. Flexibility will be available with States to decide on remuneration as in the NHM norms. A suitable honorarium for distinguished Covid Service may also be considered
12.The financial incentives/ remuneration shall be available only for those who work for at least 100 days for Covid care.
13.All Health professionals thus engaged will be covered under the Insurance Scheme of Government for health workers fighting Covid 19.
14.All such professionals who sign up for minimum 100 days of Covid duty and complete it successfully will be given the Prime Minister's Distinguished Covid National Service Samman from Government of India.
15.State/UT Governments can provide additional health professionals engaged through this process, to private Covid Hospitals as well in surge areas.
16.State Governments/ UT administrations are to ensure that the medical professionals sought to be engaged in Covid related work are suitably vaccinated.
17.The Central Government recommends to State/UT Governments to consider giving preference in regular Government appointments of Health professionals through the respective Public Service Commission/ other recruitment bodies, for those Health Professionals under this special scheme, who 48 OA Nos.3750 of 2022, 3730/2022, 156/2023 & 1082/2023 complete a minimum of 100 days of Covid related duty.
18.The State / UT Governments may also expeditiously fill vacant posts of doctors, nurses, allied healthcare professionals and other healthcare staff in Health and Medical departments through accelerated processes as soon as possible and positively within 45 days through contractual appointments.
2. This has the approval of competent authority."
18. From the aforesaid, circular it is apparent that the same was a conscious policy decision of the Government of India and notified to all the States and Union Territories. Such assurance might have influenced the applicants to apply for the aforesaid post(s) and on being selected to join the post and to continue in that capacity and once the respondents have availed their services in the light of the aforesaid assurance, we are of the considered view that the respondents while filling up the posts on regular basis must consider their claim for preference in the light of the said notification dated 03.05.2021. In this regard, we get support from the order/judgment dated 22.12.2023 of this Bench of the Tribunal in the case of Rittika Sharma (Supra). In this case, the Tribunal has considered various orders/judgments of this Tribunal, the order/judgment dated 16.11.2023 passed by the Hon'ble High Court of Judicature in Madras in Dr. D Hariharan and Ors. Vs. Union of India and Ors. wherein the claim of such health professionals who perform Covid-19 duty had been initially denied in the process of fresh recruitments. The Tribunal has also considered various judgments of the Hon'ble Apex Court as well as notification dated 03.05.2021 of the Ministry of Health and Family Welfare, Government of India, referred to hereinabove. Paras 27 and 28 of such order read as under:-
"27. We have considered the judgments cited and also the averments made in the light of the 49 OA Nos.3750 of 2022, 3730/2022, 156/2023 & 1082/2023 said judgments. It is not in dispute that the Ministry of Health and Family Welfare issued Notification dated 03.05.2021 wherein it was specifically mentioned that the preference was to be given in government regular appointments of Health professionals through the respective Public Service Commission/other recruitment bodies, for those Health professionals under this special scheme who complete a minimum of 100 days of Covid related duty. The only criteria laid down for preference was completion of minimum of 100 days of Covid related duty. The said communication did not state if those employees who were contractual or those who were engaged much before the onset of Covid- 19 were not covered by the said communication. It is also evident that this was not a case of regularisation or absorption but claiming preference in regular government appointments and therefore the ratio of judgments cited does not apply in this case. Also just because they participated in the process of recruitment do not disqualify them to claim the benefit of the circular dated 03.05.2021 as they had legitimate expectation to get preference in recruitment. Therefore, we are of the view that the competent authority while issuing the impugned advertisement should have definitely considered their case, more so, the Notification was issued by the Ministry of Health and Family Welfare under which the Lady Hardinge Medical College is placed.
28. In the facts and circumstances, we hereby direct the competent authority amongst the respondents to consider their cases in line with their own Notification dated 03.05.2021 by grant of preference to the applicants. The competent authority amongst the respondents will issue necessary directions in this regard as expeditiously as possible and preferably within a period of 8 weeks from the date of receipt of a copy of the order."

19. For paucity of time, reserved for orders. Interim relief, shall continue till further order(s)."
2. In OA No.2633/2021, titled Ranjeet Singh and others vs. Union of India and others, the applicants were Staff Nurses working on contract basis in different hospitals of the Govt. of India located in the National Capital Territory of Delhi. They are said to have been engaged on contract to tide over the crises on account of the COVID pandemic. They had a legitimate expectation that at an appropriate time their services as Staff Nurse will be regularized or in the alternative, they shall be given some preference in recruitment/appointment of Staff Nurses in terms of the policy notified by the Government on 03.05.2021. In the meanwhile, the respondents had issued an advertisement dated 16.10.2021 inviting applications for recruitment to the post of Staff Nurse and pursuant to that a selection examination had been conducted. In this case, the coordinate Bench of this Tribunal has extensively considered the common Order/Judgment dated 22.12.2023 in OA No. 509/2022 and a Batch of cases, titled Rittika Sharma and others vs. Union of India and others, and connected cases, and 51 OA Nos.3750 of 2022, 3730/2022, 156/2023 & 1082/2023 has also reproduced various paras thereof in paras 10 and 11 of the final order/judgment dated 18.1.2024. Paras 14 and 15 of the same read as under:-
"14. Let us go back to para 28 of the order passed in OA No. 509/2022. What this para does is direct the competent authority to "consider" the case of the applicants in line with their own notification dated 03.05.2021 by grant of preference to the applicants. The policy "recommends" to "consider" giving preference. The directions of the Tribunal are also to consider giving the said preference, that too, strictly in accordance with the policy. We have no doubt that judicial propriety and discipline binds us to decide this OA on the same analogy of OA No. 509/2022.
15. In view of what has been elaborately detailed and discussed above, the present OA is disposed of with a direction to the competent authority amongst the respondents to consider the claim of the applicants strictly in accordance with the provisions of the notification dated 03.05.2021, specifically the provisions providing preference to such employee as the present applicants are. Pursuant to such consideration, the respondents shall take an appropriate decision in this matter expeditiously, in any case, not later than a period of eight weeks from the date of receipt of a copy of this order. The directions given vide the interim order dated 18.11.2021 shall remain in operation till such a decision is taken by the competent authority."

However, it is pertinent to record that in the case of Ranjeet Singh (supra), it was not brought to the 52 OA Nos.3750 of 2022, 3730/2022, 156/2023 & 1082/2023 notice of the Tribunal that the advertisement/notice referred to by the applicants in the present OA to indicate that respondents were in the process of engaging new set of contractual employees on daily wages had been kept in abeyance. The judgment of the Hon'ble Supreme Court in the case of Tejram Parashramji Bombhate (supra) was also neither brought to the notice of the Tribunal nor the same was considered. Furthermore, in the present case, it has been strenuously argued on behalf of the respondents that whether the respondents are in further need of continuing the applicants' services, who were engaged in extra ordinary Covid-19 pandemic situation, is a matter which deserves to be left to the respondents.

In the case of Devendra Kumar Saini and others vs. Union of India and others, reported in MANU/CA/0354/2023, decided by the coordinate Bench of this Tribunal at Chandigarh, the Original Application was filed by the applicants therein against the order dated 28.9.2022 whereby the applicants have been terminated and the applicants have sought 53 OA Nos.3750 of 2022, 3730/2022, 156/2023 & 1082/2023 directions to regularize their services and to extend the consequential benefits. The applicants in the said case had applied in response to the recruitment notice dated 1.2.2020 for the post of Staff Nurse for a period of six months on contract basis. They fulfilled the eligibility criteria and upper age limit. The applicants were selected on the recommendations of the counselling committee. Their engagement during Covid-19 pandemic was also considered by the respondents. However, it is a fact that neither the reliefs sought nor the facts of the case in hand are similar to those in the case of Devendra Kumar Saini (supra), besides the respondents are also not same. In such view of the matter, we are of the considered view that though the learned counsels for the parties have prayed for similar relief(s) to the applicants in the present OAs, however, the same cannot be granted in the same line.

In the facts and circumstances of the case in hand, the issue requires adjudication by this Tribunal is as to whether the applicants in the present OA, who 54 OA Nos.3750 of 2022, 3730/2022, 156/2023 & 1082/2023 have been engaged directly by the competent authority amongst the respondents, can be replaced by another set of daily wagers/fresh contract employees directly or through outsourcing agency or not?
6. This issue is no more res integra in view of the Order/Judgment passed by the coordinate Bench of this Tribunal, consisting one of us (Hon'ble Shri R.N. Singh, Member (J)) in OA No.2112/2020, titled Ashok Kumar and others vs. Govt. Of NCT of Delhi and others, decided on 5.3.2021. In the case of Ashok Kumar (supra), this Tribunal considered and relied upon the decision of the Hon'ble High Court of Delhi in the case of Narinder Singh Ahuja and others vs. The Secretary, Ministry of Health and Family Welfare and others (WP (C) No.1741/2014 decided on 3.11.2014), which was upheld by the Hon'ble Supreme Court, as the Special Leave to Appeal (Civil) No.8706/2018 preferred by the Union of India to challenge the said order/Judgment of the Hon'ble High Court of Delhi in Narinder Singh Ahuja's case (supra) has been 55 OA Nos.3750 of 2022, 3730/2022, 156/2023 & 1082/2023 dismissed by the Hon'ble Apex Court vide Order/Judgment dated 27.3.2015. The paras 12 to 17 of the Order/Judgment dated 5.3.2021 of this Tribunal read as under:-
"12. In the case of Narinder Singh Ahuja (supra), the petitioners were aggrieved by an Order dated 10.1.2014 passed by this Tribunal in OA 1016/2013, wherein the petitioners had initially approached this Tribunal vide said OA on being aggrieved by non-extension of their contractual appointments. They had complained about the respondents' action in discontinuing the petitioners' contracts. This Tribunal has dismissed the said OA vide order/judgment dated 10.1.2014 and thus the petitioners therein in the said OA approached the Hon'ble High Court of Delhi vide Writ Petition (Civil) No.1741/2014 and the Hon'ble High Court of Delhi vide very detailed discussion has ruled in paragraphs 15 to 17 as under:-
15. In the opinion of this Court, since the respondents nowhere dispute that there is need for the performance of the work that the petitioners were discharging all along and there is also no dispute that the project and funding (for the project) would continue till 2017, the decision to discontinue the petitioners' engagement is based only on the policy to outsource the contractual employment to a third party.
The petitioners are not insisting on regularization, given the nature of the employment or engagement, which is project based. However apart from the decision to "outsource" engagement of contract employment to a third agency, there is no rationale to discontinue the petitioner' contracts. The jurisdiction that 56 OA Nos.3750 of 2022, 3730/2022, 156/2023 & 1082/2023 the employees engaged through the contractor are paid lower wages is arbitrary, because the "outsourced" or outsourcing agency would have to be paid its service charges. The lower wages paid, therefore, is, in effect, because of the charges/fees paid to the contractor/outsourced agency. The facts of this case clearly reveal that even though the work is to be performed by contractual employees, the reason for discontinuance of the petitioners' employment is not their replacement with regular appointees, but instead, with another set of contractual employees. The state/respondents cannot, in the circumstances of this case, say that discontinuance of such employment cannot be gone into by the Court because the petitioners were aware that their contracts ended.
16. For the above reasons, this court is of opinion that the CAT erred in law, in holding that the petitioners could not complain against the discontinuance of their contractual employment.
Accordingly, a direction is issued to the respondents to continue the petitioners in contractual employment on annual renewal basis, till the currency of the RNTCP scheme/project in 2017. An appropriate consequential order shall be issued by the respondents within eight weeks from today.
17. The impugned order of the CAT is accordingly set aside; the writ petition is allowed in terms of the above directions."

The said judgment dated 3.11.2014 of the Hon'ble High Court of Delhi in Narinder Singh Ahuja's case (supra) was challenged by the Union of India before the Hon'ble Supreme Court 57 OA Nos.3750 of 2022, 3730/2022, 156/2023 & 1082/2023 and the Hon'ble Apex Court has dismissed the Special Leave to Appeal (Civil) No.8706/2018 vide Order/Judgment dated 27.3.2015 (Annexure A/7). In Shikha Jain's case (supra), the applicants, eight in numbers, who had been working as Programme Assistant on contract basis in the National Aids Control Organization of Ministry of Health and Family Welfare, Govt. of India, have approached this Tribunal vide OA No.2149/2016. The grievance of the applicants therein was that the respondents have not been extending their respective contract beyond 30.6.2016 mainly on the ground that the respondents have decided to hire the support staff from the domestic budgetary support through an outsource agency. After considering various decisions of the Hon'ble Supreme Court as well as the judgement of the Hon'ble Delhi High Court in Narinder Singh Ahuja's case (supra), this Tribunal held in paragraphs 9 and 12 of the Order/judgment dated 12.8.2016 (Annexure A/8) as under:-
"9. Admittedly, it is not the case of the respondents that there is no work available after 30.06.2016. On the other hand, it is specifically stated that they will hire the support staff through an outsourced agency. That means that the respondents are intending to replace the applicants, who are working on contract basis, for the last few years, with another set of contract employees, may be, through outsourced agencies. The said action of replacing one set of contract employees with another set of contract employees is clearly against to the settled principles of law. Even the aforesaid decision of the Hon'ble High Court is to the same effect."
"12. In the circumstances and for the aforesaid reasons the OA is partly allowed and accordingly, the 58 OA Nos.3750 of 2022, 3730/2022, 156/2023 & 1082/2023 respondents are directed to continue the applicants on the same terms and conditions as long as there is work or till the vacancies are filled up on regular basis. No order as to costs."
14. The Order/Judgment of this Tribunal in Shikha Jain's case (supra) was challenged by the Union of India before the Hon'ble High Court of Delhi vide writ Petition (Civil) No.5073/2017 and the Hon'ble High Court had dismissed the said Writ Petition vide Order/Judgment dated 27.3.2017 (Annexure A/9) and in paragraphs 13 to 15 of the said Order/Judgment, the Hon'ble Delhi High Court has ruled as under:-
"13. The Tribunal has placed reliance on the decision of this Court in Narinder Singh Ahuja and Others Vs. The Secretary, Ministry of Health And Family Welfare & Others, W.P. (C.) No. 1741/2014 decided on 03.11.2014. In paragraph 15 of this decision, the Division Bench held as follows:
"15. In the opinion of this Court, since the respondents nowhere dispute that there is need for the performance of the work that the petitioners were discharging all along and there is also no dispute that the project and funding (for the project) would continue till 2017, the decision to discontinue the petitioners' engagement is based only on the policy to outsource the contractual employment to a third party. The petitioners are not insisting on regularization, given the nature of the employment or engagement, which is project based. However apart from the decision to "outsource" engagement of contract employment to a third agency, there is no rationale to discontinue the petitioners' contracts.59 OA Nos.3750 of 2022, 3730/2022,
156/2023 & 1082/2023 The justification that the employees engaged through the contractor are paid lower wages is arbitrary, because the "outsourced" or outsourcing agency would have to be paid its service charges. The lower wages paid, therefore, is, in effect, because of the charges/fees paid to the contractor/ outsourced agency. The facts of this case clearly reveal that even though the work is to be performed by contractual employees, the reason for discontinuance of the petitioners' employment is not their replacement with regular appointees, but instead, with another set of contractual employees. The state/respondents cannot, in the circumstances of this case, say that discontinuance of such employment cannot be gone into by the Court because the petitioners were aware that their contracts ended."
14. The aforesaid decision has been relied upon by the Tribunal in the impugned order, since the endeavour of the petitioners is to replace the respondents with an outsourcing agency on contract basis. Learned counsel for the respondents has pointed out that the said decision has been affirmed by the Supreme Court with the dismissal of the Special Leave Petition on 27.03.2015 vide Special Leave Petition (Civil) No.8706/2015.
15. In these circumstances, we find absolutely no merit in this petition. The same is, accordingly, dismissed."

From the law laid down by the Hon'ble Apex Court in Piara Singh's case (supra) and that by the Hon'ble High Court of Delhi in Narinder Singh Ahuja's case (supra) and 60 OA Nos.3750 of 2022, 3730/2022, 156/2023 & 1082/2023 Shikha Jain's case (supra), it is evident that replacement of a contract employee(s) by fresher(s), junior(s) or even a staff from an outsource agency is prohibited. No statutory provision has been brought to our notice by the respondents, which takes away the right of preferential treatment to the daily wager or contractual employees, who are already engaged and are working for continuation on contract to junior(s), fresher(s) or the person(s) to be engaged through outsourcing agency to be taken away.
16. In view of the facts as noted hereinabove and law as laid down by the Hon'ble Supreme Court of India and Hon'ble High Court of Delhi, referred to hereinabove, we are of the considered view that action of the respondents of not continuing the engagement of the applicants as Driver on contract basis and their action of replacing them by another set of contractual employees through outsourcing is not tenable in the eyes of law.
17. In the result, for the foregoing reasons, the present OA is partly allowed and the respondents are directed to continue the applicants on the same terms and conditions of on contract basis as long as there is work available with the respondents and/or till the vacancies are filled up on regular basis. The respondents are further directed to issue consequential order as expeditiously as possible and in any case within four weeks of receipt of a copy of this Order. No costs."
7. In view of the aforesaid, the present OAs are partly allowed with the following directions/orders:-
(i) The respondents shall be bound by their statement regarding payment of admissible dues, salary, perks, etc. to the applicants as 61 OA Nos.3750 of 2022, 3730/2022, 156/2023 & 1082/2023 recorded hereinabove in para 8 of Order dated 8.5.2024, which is reproduced in para 1 above;
(ii) The respondents shall continue the applicants in preference to any junior(s) and fresher(s) on daily wages/contractual basis engaged directly and/or through any outsourcing agency;
(iii) The respondents shall take an appropriate decision in respect of grant of relaxation of age and/or for additional weightage in view of notification dated 3.5.2021 of the Govt. of India, Ministry of Health and Family Welfare, referred to hereinabove while considering them for appointment on regular basis; and
(iv) The aforesaid directions shall be complied with by the respondents as expeditiously as possible and preferably within eight weeks of receipt of a copy of this Order.
9. The associated MA(s), if any, shall also stand disposed of accordingly.

10. However, in the facts and circumstances, there shall be no order as to costs.
11. Registry is directed to place a copy of this Order in each connected OAs.
