1. Heard learned counsel appearing on behalf of the petitioner, Mr. Dhananjay Awasthi, learned counsel for respondent No. 3 and Mr. Arvind Mishra, learned counsel for respondent Nos. 4 and 5.
2. It is submitted by learned counsel for the petitioner that the issue as raised in the present petition is engaging attention of this Court in Writ Tax No. 1117 of 2024 wherein respondents have been called upon to file counter affidavit and interim order has been granted.
3. It is also pointed out that similar nature issue is already pending consideration before Hon'ble Supreme Court in M/s HCC-SEW-MEIL-AAG JV Vs. Assistant Commissioner of State Tax & Ors.: Petition for Special Leave to Appeal (C) No. 4240 of 2025.
4. In view of submissions made, connect with Writ Tax No. 1117 of 2024 and counter affidavit be filed within a period of four weeks.
5. In the meanwhile and until further orders, pursuant to the order dated 06.08.2024, no coercive process for recovery of demand for Financial Year 2019-20 shall be adopted by the respondents.
