Information soughtand background of the case:
The Appellant filed an RTI application dated 08.11.2024 seeking information on the following points:
"I want the following information under RTI Act 2005.
1) I took a housing loan from ICICI Bank in the year 2021 under PMAY scheme. My CLAP ID is C0002094578 which is provide by ICICI Bank. But till date the subsidy of PMAY scheme has not been deposited in my housing loan account. So I want this information from you that when will the subsidy of PMAY scheme be deposited in my housing loan account?
2) At what stage (step) has my subsidy status arrived? Please provide the status of my subsidy with screenshot of www.pmayuclap.gov.in
3) If my home loan is completed and the subsidy has not been deposited in my bank account till then, then will I get the home loan subsidy?
4) The amount of PMAY subsidy is given by the government, how much fund has been given under PMAY subsidy to National Housing Bank till date?
5) When was the last time PMAY subsidy fund was will be given to National Housing Bank and how much fund provided by government?
6) How many people were given subsidy from last time in year of 2021 to till date?

The CPIO replied vide letter dated 06.12.2024 and the same is reproduced as under:-
"Reply of 1 to 3. Based on search made with the Application ID as provided, a subsidy claim of ₹1,44,543/- (Loan Tenure: 120 months) was found uploaded under Pradhan Mantri Awas Yojana - Credit Linked Subsidy Scheme (PMAY-CLSS) for MIG by the Primary Lending Institution (PLI) on 03-03-2021 on the PMAY-CLSS portal maintained by National Housing Bank (NHB). The claim cleared Step
2.4 on 24-08-2021 as per the PMAY-CLSS Flow Chart (Attached as Annexure - 1).
Credit Linked Subsidy Scheme for Middle Income Group (CLSS for MIG) was effective from 01-01-2017 and was operational up to 31- 03-2021. Based on communication received from Ministry of Housing and Urban Affairs (MoHUA), PLIs were advised to upload the eligible MIG claims on the PMAY-CLSS portal maintained by the Central Nodal Agency (CNA) latest by 21-07-2021. No funds for CLSS for MIG are being released from the MoHUA after FY 2020-21.
No specific timeline has been prescribed in the Scheme Guidelines of PMAY (Urban) Housing for All. Applicant may track the subsidy claim status using the Application ID through CLSS Awas Portal (CLAP).
The Information/Query ("when will the subsidy of PMAY scheme be deposited in my housing loan account") requires drawing of inferences and/or making of assumptions and giving advice or opinion and therefore cannot be said to be included in the definition of information under Section 2 (f) of the RTI Act, 2005.
Further, Section 2(f) of the RTI Act, 2005 defines "information" means any material in any form, including records, documents, memos, e- mails, opinions, advices, press releases, circulars, orders, logbooks, CIC/NHBNK/A/2025/601032 Page 3 of 7 contracts, reports, papers, samples, models, data material held in any electronic form and information relating to any private body which can be accessed by a public authority under any other law for the time being in force."
Reply of 4 & 5 The details of funds released by the Ministry to Central Nodal Agencies (CNAs) under PMAY-CLSS may be accessed by using the link below:

Dissatisfied with the response received from the CPIO, the Appellant filed a First Appeal dated 06.12.2024. The order of FAA is not available as per record.
Aggrieved and dissatisfied, the Appellant approached the Commission with the instant Second Appeal.
Facts emerging in Course of Hearing:
The appellant was present through video conference.
The respondent Mr. Rajiv Rajan, CPIO, Mr. Anurag Saxena, Consultant and Mr. Rahul Kumar Meena, Assistant Manager, were present in-person.
The appellant inter alia submitted that he has sought information sought on point no. 3 and 5 has not been provided by the respondent. He further submitted that the subsidy under PMAY scheme has not been provided to him, by the respondent yet.
The respondent while defending their case inter alia submitted that the reply to the RTI application has been provided to the appellant vide letter CIC/NHBNK/A/2025/601032 Page 4 of 7 dated 06.12.2024. The respondent further submitted that they have not received the payment from the concerned ministry since 19.03.2021, subsequently the scheme was closed, hence funds could not be released to the concerned bank.
A written submission dated 12.03.2026 of the respondent is stated as under:-
"1.1 The Appellant submitted an RTI Application on 08.11.2024 seeking certain information on 6 queries, as detailed in the said Application.
1.2 CPIO vide his letter dated 06.12.2024 made reply to the Appellant on all the 6 queries.
1.3 The Appellant filed First Appeal on 06.12.2024 (copy enclosed as Annexure-3) stating that CPIO has not answered 3rd & 5th Query of his RTI Application, which reads as under: -
Q-3 If my home loan is completed and the subsidy has not been deposited in my bank account till then, then will I get the home loan subsidy?
Q-5 When was the last time PMAY subsidy fund was will be given to National Housing Bank and how much fund provided by government?
1.4 The said First Appeal was decided by the First Appellate Authority vide Order Dated 06.01.2025 (copy enclosed as Annexure-4) and was uploaded on the Portal on 06.01.2025.
1.5 Regarding information sought by Appellant in his Query No-3 above, the CPIO has already informed the Appellant that the information sought requires drawing inferences and/or making CIC/NHBNK/A/2025/601032 Page 5 of 7 assumptions and giving advice or opinion, as such doesn't come under the definition of information under section 2(f) of the RTI Act, 2005.
Further CPIO has also informed the Appellant that no funds are being released from Ministry after FY 2020-21.
1.6 Regarding information sought by the Appellant in his Query No-5 above CPIO has provided a web-link to the Appellant wherefrom he can access detailed information regarding funds provided by Government towards PMAY subsidy.
Since the information sought by the Appellant is already published on the website provided by the CPIO, which is available to the Public, the Appellant can access the same for the information required by him."
Decision:
In the light of the above facts, the Commission noted that the respondent has replied to the appellant vide letter dated 06.12.2024, no further intervention by the Commission is required in the matter, accordingly, the appeal is disposed.
