ORDER
Information sought:
The Appellant filed online RTI Application dated 12.08.2020 seeking information as under:
"I want copy of my MS degree pertaining to department of Physics, my Student registration no. is 404063047060."
The CPIO vide online reply dated 10.09.2020, informed to the Appellant as under:
"On verification of the Name, Address, Telephone Number student registration number furnished by the RTI applicant, it is noted that the RTI applicant was not a student of our Institution."
Being dissatisfied, the Appellant filed a First Appeal dated 10.09.2020. The First Appellate Authority vide order dated 22.09.2020, informed as under:
"No attachment found. There is a defined process to apply for original degree. http://www.iisc.ac.in/about/student-corner/procedure-for-obtaining-official- transcripts/ "
Grounds for Second Appeal:
The Appellant filed a Second Appeal u/s 19 of the Act on the ground of unsatisfactory reply furnished by the Respondent. Appellant requested the Commission to direct the CPIO to provide complete information sought for.
Submissions made by Appellant and Respondent during Hearing:
The Appellant stated that the Respondent has provided a provisional MS degree in the year 2014. He further expressed his desire to get his MS degree certificate from the concerned university.
The Respondent submitted that the provisional MS degree of which the Appellant is talking about is mere a certificate wherein it has been clearly mentioned that the Appellant will be awarded MS degree along with PhD degree on completion of Page 2 of 5 CIC/MOHRD/A/2020/134913 required formalities. He further apprised the bench that the Appellant's registration has been cancelled on 31.07.2015 for the entire integrated PhD course as he has not submitted his thesis after completing the master degree. He furthermore submitted that the concerned matter is also sub-judice in the High Court of Karnataka in Writ Petition no. 52603 of 2019 which is pending adjudication.
A written submission has been received by the Commission from the Appellant vide letter dated nil, wherein the Commission has been apprised as under:Page 3 of 5
CIC/MOHRD/A/2020/134913 Decision:
Upon perusal of the facts on record as well as on the basis of the proceedings during the hearing, the Commission observes that since Appellant's registration has been cancelled on 31.07.2015 for the entire integrated PhD course qua which the matter is also under consideration of the Hon'ble High Court of Karnataka in Writ Petition no. 52603 of 2019 which is pending adjudication, the Commission is unable to provide any relief to the Appellant at this stage. Hence, the Commission finds no further scope of intervention in the instant matter. With the above observations, the instant Second Appeal is disposed of. Copy of the decision be provided free of cost to the parties.
The Appeal, hereby, stands disposed of.
