Heard learned counsels for the petitioner and the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 272, 273, 420 of the Indian Penal Code and section 16 of Prevention of Food Adulteration Act.

Rotting khowa, sour milk and powder were seized from the house of the petitioner when one Pawan Sah was apprehended, who conveyed that the petitioner used to make sweets out of the milk products.

It is submitted by learned counsel for the petitioner that the seized samples have not been sent to analyst which is violative of the provisions of Prevention Patna High Court Cr.Misc. No.5205 of 2012 (2) dt.23-02-2012 2/2 of Food Adulteration Act.

Considering the aforesaid submissions and the nature of the recovery, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui in connection with Jamui P.S. Case No. 351 of 2011, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
