33. Cognizance of offences.
(1)No Court shall take cognizance of any offence punishable under this Act and the rules made thereunder unless a complaint in respect thereof is made by the Inspector within three months from the date on which the alleged commission of the offence comes to the knowledge of the Inspector:Provided that, where the offence consists of disobeying a written order made by the Inspector, complaint thereof may be made within six months from the date on which the offence is alleged to have been committed.(2)The court of a Metropolitan Magistrate or a Judicial Magistrate of the First Class shall try any offence punishable under this Act or the rules made thereunder.(3)Notwithstanding anything contained in Code of Criminal Procedure, 1973, (2 of 1974) a Metropolitan Magistrate or a Judicial Magistrate of the First Class may impose fine and penalties prescribed under this Act.
