1. This hearing has been done through hybrid mode. CRL.M.(BAIL) 108/2026 (for interim suspension of sentence)

2. This is an application filed by the Appellant seeking interim bail for a period of 60 days on the ground that he has already undergone imprisonment for about 6 years and has two sons of marriageable age.

3. The Appellant has been found guilty of having murdered his wife, and accordingly, has been convicted for offence punishable under Section 302 of IPC. The Appellant has been sentenced to rigorous imprisonment for life and the relevant portion of the order on sentence is as under:

I have considered all the arguments and the facts of the present case. The convict is sentenced to Rigorous Imprisonment for Life and fine of Rs.20,000/- for the offence u/s 302 IPC. In default of payment of fine, the convict to undergo RI for one year.

Benefit u/S 428 Cr.P.C. is given to the convict."

4. On 19th January, 2026, the Court had directed the State to verify the facts stated in the application and requisition the latest Nominal Roll.

5. The Appellant has been in custody for a period of 5 years, 10 months and 18 days, as per the latest Nominal Roll dated 6th February, 2026. Further, the Appellant has earned remission of 4 months and 25 days.

6. The Court has heard the ld. Counsel for the Appellant and the ld. APP for the State. The Court has also perused the testimony of PW-12 as also the reasons given in the present application for seeking interim bail.

7. The Appellant has two sons. This fact has been verified by the police. The Status Report dated 12th February, 2026 signed by SHO, P.S. Sagarpur has been handed across by the ld. APP for the State. The said report is taken on record.

8. The reason mentioned in this application seeking interim bail is for fixing the marriage of Appellant's sons. The status report, however, reveals that one of the sons of the Appellant, namely, Mr. Sanjay was enquired by the police and he stated that at the moment, there is no engagement which has been fixed for him. He also claimed that his brother is not living with him.

Without going into the reasons why the brother is not living with Mr. Sanjay, it is clear from the submissions of the parties and the status report that the Appellant ought to be permitted to interact with both the sons to re- establish ties with family and in society. In the opinion of the Court, it is clear that the Appellant's presence would be required for both sons.

Under these circumstances, the Appellant is released on interim bail for a period of 30 days from the date of his release, upon furnishing of a personal bond in the sum of Rs. 10,000/- with one surety of like amount, to the satisfaction of the Trial Court/link Court, further subject to the following conditions:

i. The Appellant shall not leave India without prior permission of this Court;
ii. The Appellant shall report at the concerned police station on every Monday at 11:00 A.M. and shall be discharged by 12:00 P.M., after recording his presence and completion of all the necessary formalities;
iii. The Appellant shall provide his live phone number and residential address, where he would be living upon release, to the concerned Investigating Officer (IO) and regularly update the IO about change in the address and phone number, if any. The Appellant shall keep his phone number operational at all times. iv. The Appellant shall not indulge in any criminal activity and upon any such activity being discovered or indulged into, the present interim bail shall automatically stand cancelled; v. After completion of the period of interim bail of 30 days from the date of release, the Appellant shall immediately surrender before the concerned Jail Superintendent.

11. The application is disposed of in the above terms.
