3 03-09-2013Heard learned counsels for the petitioners and the State.
The petitioners are apprehending arrest in a complaint case in which cognizance has been taken under Sections 120B, 420, 467, 468 and 471 of the Indian Penal Code.
It is alleged that 13 dhurs of land was transferred through registered sale deed by co-accused Namonath Jha in favour of the complainant but in place of plot no. 336, Plot No. 337 was mentioned in the sale deed. Initially, the vender was ready to get the correction made but subsequently, he refused to do so. It is alleged against the petitioner being the relation of Namonath Jha that he is only the identifier of the vendor.
It is submitted by learned counsel for the petitioner that the thrust of accusation is against Namonath Jha and the vender is still ready for correction of the sale deed.
It is submitted by learned counsel for the complainant that the petitioner being the relation of the vender was aware about Patna High Court Cr.Misc. No.9658 of 2013 (3) dt.03-09-2013 2/2 the deliberate wrong mentioning of plot number in the sale deed.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Motihari in connection with Complaint Case No. 1512 of 2010, subject to the conditions as laid down under Section 438(2) Cr.P.C.
The grant of bail to the petitioner will not preclude him to persuade the vender for getting the sale deed corrected.
