Heard Mr. Talha Abdul Rahman and Sri Amit Singh Bhadauriya, learned Counsel for the petitioner, Sri H. P. Srivastava, learned Additional Chief Standing Counsel for opposite party Nos.1 and 2 and Sri Anurag Kumar Singh, learned Counsel for State Election Commission.
This review application has been filed arising out of the judgment and order dated 15.3.2021, passed in P.I.L. Civil No. 6929 of 2021, Ajay Kumar v. State of U.P. and others.
We have been informed that subsequent to the judgment under review, the State Government has amended Rules, namely, Uttar Pradesh Panchayat Raj (Reservation and Allotment of Seats and Offices) (Twelfth Amendment) Rules, 2021 vide notification dated 17.3.2021 by inserting Rule 2 (d) in Rule 2 of Uttar Pradesh Panchayat Raj (Reservation and Allotment of Seats and Offices) Rules, 1994. It has also been brought to our notice that the State Government has subsequently issued the Government Order dated 17.3.2021.
Learned counsel for the review applicant informs that he has challenged the notification dated 17.3.2021 amending the 1994 Rules as well as Government Order dated 17.3.2021 by filing Writ Petition No.9605 (MB) of 2021 which is also listed today in the fresh cases.
Sri Anurag Kumar Singh, learned Counsel for the State Election Commission informs that the State Election Commission has issued the notification for Panchayat Raj Elections vide notification dated 26.3.2021.
In view of above, since subsequent changes have been brought to the 1994 Rules and the State Government has issued the Government Order dated 17.3.2021, we are of the considered view that the Review Petition in the changed circumstances would not be maintainable.
The Review Petition is accordingly dismissed.
