Information sought

:

1. The Appellant filed an RTI application dated 28.04.2025 seeking the following information:
"Subject: Request for NEET-UG 2020 Scorecard under RTI Act, 2005 To, The Central Public Information Officer (CPIO), National Testing Agency (NTA), Page 1 of 4 Ministry of Education, Government of India.
Respected Sir/Madam, I, SAHIL YADAV, son/daughter of ******, kindly request a copy of my NEET-UG 2020 Scorecard under the Right to Information Act, 2005. My details are as follows: Application Number: 2025042811863 Date of Birth: 19/02/2002 Registered Email/Mobile (during NEET 2020): ********* Reason for Request: Unfortunately, I have lost my original NEET-UG 2020 scorecard, and I urgently require it for my Foreign Medical Graduate Examination (FMGE) eligibility verification. This document is mandatory for my medical career, and I humbly request your assistance in providing a certified copy. I would be extremely grateful if you could provide me with the same at the earliest. Please let me know if any additional formalities or fees are required."

2. The CPIO furnished a reply to the Appellant on date Nil stating as under:

"As mentioned in Clause 15.6 of the Information Bulletin of NEET (UG) 2020, the record of National Eligibility cum Entrance Test NEET (UG) 2020 would be preserved up to 90 days from the date of declaration of result. Copy of the mentioned Clause is attached herewith."

3. Aggrieved by the decision of the CPIO, the Appellant filed a First Appeal dated 09.05.2025. The FAA vide its order dated Nil, stating as under-

"After considering the all the facts following decision is communicated: It is stated that the information desired by you is no more available in the format desired by you. this aspect is clearly stated in the weeding out rules mentioned in NEET 2020 UG Information bulletin at chapter 15. The record of National Eligibility cum Entrance Test NEET (UG)-2020 would be preserved up to 90 days from the date of declaration of result. An appeal against the aforesaid decision of the appellate authority can be made with the Central Information Commission, Baba Gang Nath Marg, Munirka, New Delhi - 110067 within 90 days as provided under sub- section (3) of the Section 19 of the Right to Information Act, 2005."

4. Challenging the FAA's order, Appellant is before the Commission with the instant Second Appeal.

Respondent: Shri Kumar Niloy, Dy. Director-cum-CPIO present in person.

5. Written statement dated 12.05.2026 filed by the CPIO is taken on record.

6. Appellant did not turn up for hearing despite service of hearing notice. Therefore, to facilitate due assistance, the Bench tried to contact the Appellant on phone-call. Upon being contacted through call, the Appellant stated that after filing the Second Appeal, he got the desired information through alternative mode and is satisfied with the same. The Appellant further stated that since he had received the requisite information, this Appeal may be closed accordingly.

CPIO by placing reliance on his written statement stated that as per clause 15.6 mentioned in information bulletin of NEET (UG) 2020, the records of NEET (UG)-2020 are preserved for 90 days from the declaration of results and as per the norms the records have been weeded out. Therefore, the score card of NEET (UG) 2020 is not available with the CPIO and this fact was informed to the Appellant at the initial stage itself.

Decision:

8. Heard the parties.

The Commission on a perusal of facts and records placed on file, and after hearing both the parties considers that the main premise of instant Appeal was non-receipt of desired information from the CPIO. Per contra, it was submitted by the CPIO that that as per clause 15.6 mentioned in information bulletin of NEET (UG) 2020, the records of NEET (UG)-2020 are preserved for 90 days from the declaration of results and as per the norms the records have been weeded out prior to receipt of RTI application in question. Therefore, the score card of NEET (UG) 2020 is not available with the CPIO and this fact was informed to the Appellant at the initial stage itself.

The Commission notes that the reply provided by the CPIO by clarifying the factual position as explained in para 9 above is well within the provisions of the RTI Act, 2005, as the CPIO can only provide such information as is held in the office record, and as a matter of fact, he is not obligated to create Page 3 of 4 information under the mandate of RTI Act. The Commission placed reliance on a judgement passed by the Hon'ble High Court of Delhi dated 04.12.2014 in the case of The Registrar, Supreme Court of India vs. Commodore Lokesh K. Batra and Ors. [W.P.(C) No. 6634/2011], wherein the Court has held as under:

"11. Insofar as the question of disclosing information that is not available with the public authority is concerned, the law is now well settled that the Act does not enjoin a public authority to create, collect or collate information that is not available with it. There is no obligation on a public authority to process any information in order to create further information as is sought by an applicant......."

11. Having observed as above and considering the submission of the Appellant that he has received the desired information through alternative mode, the Commission finds no scope to intervene in the matter and submissions of the CPIO are upheld.

The Appeal is disposed of accordingly.
