2 31-01-2020This writ application has been filed seeking a direction to the respondents to consider his claim for regular appointment on the post of Night Guard or any Class-IV post in the Collectorate of the District of Katihar or any other department. It is the petitioner's case that his matter is pending before the District Appointment Committee since long.
Learned counsel appearing on behalf of the petitioner has submitted that on 19.10.2009, the District Registrar-cum- Collector, Katihar had written a letter to the Commissioner for age relaxation, for the petitioner's appointment on regular basis, as on the said date he had crossed the age of 46 years. Patna High Court CWJC No.239 of 2020(2) dt.31-01-2020 2/2 The petitioner is more than 57 years of age as on date. There is nothing on record to suggest that his initial engagement was on the basis of any advertisement or after following process of selection. Statutory rules have been framed now for filling up Group-D post in the Collectorate and other connected offices and any appointment against such posts can be made in accordance with the statutory provisions only.
The petitioner has admittedly attained the age of 57 years. I am of the view that no relief, as is being sought can be granted to the petitioner in the facts and circumstances noted above. This application is accordingly dismissed.
