1. Mr. Hossain Sr. Standing counsel for the respondent Department, at the outset points out that the W.P. (C) No. 5559/2021 Deepak Talwar Vs Union of India & Ors, which also forms a part of the tabulation hus been apparently inadvertently, listed before the Division Bench-IV as Item- 41, the same is not listed before this Court wherein one common issue is arising.
2. We permit Mr. Hossain to request the Hon'ble Chief Justice as well as Signature Not Verified Digitally Signed By:BHUPINDER SINGH ROHELLA Signing Date:05.03.2022 16:37:16 the Division Bench-IV to list the matter before this Court along with the present batch.
3. Mr. Hossain, further submits that rejoinders have been filed in some matters only a day before yesterday. He further submits that applications for adjournments have been moved since the learned SG, who is leading in the matters, is appearing before the Supreme Court in a part-heard matter.
4. It is pointed out by the learned counsels for the petitioners that notices have been issued against the petitioners to enforce penalty. Mr. Hossain submits that with a view to obviate any objection in regard to the penalty notices getting time barred, notices have been issued.
5. We direct that the penalty proceedings shall remain stayed till further orders, where the notices for the same have been issued.
6. List before the Court on 11.07.2022.
7. Interims orders to continue.
8. In the meantime, the pleadings in other matters shall be completed. List the matters before the Joint Registrar for that purpose on 22.03.2022.
