2. The facts of the case as averred by the applicants in their pleadings, are as follows: -
a) The applicants in the present batch of Original Applications, namely O.A. No. 643/2022, O.A. No. 2051/2025 and O.A. No. 2052/2025, were appointed as Fireman / Fireman Driver in the Fire & Emergency Services Department of the Union Territory of Jammu and Kashmir pursuant to a recruitment process conducted by the competent recruiting authority of the department. The recruitment process included physical tests, written examination, verification of documents and medical examination, after which appointment orders were issued in favour of the selected candidates. The applicants thereafter joined service and were posted at different fire stations across the Union Territory.

b) It is the case of the applicants that after their appointment they continued to discharge their duties sincerely and their service record remained satisfactory. They further state that the recruitment process pursuant to which they were appointed had earlier been challenged before the courts; however, the challenges were dismissed and the legality of the selection process was upheld by the High Court, thereby affirming the appointments made pursuant to the said recruitment.
c) The applicants in O.A. No. 643/2022 belong to the same recruitment process relating to the post of Fireman/Fireman Driver in the Fire & Emergency Services Department and have questioned the legality of the selection process as well as the appointments made thereunder, arraying a large number of selected candidates as private respondents. OA 643 of 2022.
d) Subsequently, allegations surfaced regarding irregularities in the recruitment process of Fireman/Fireman Drivers in the Fire & Emergency Services Department. In view of these allegations, the Government constituted an Inquiry Committee HARSHIT Digitally signed by YADAV HARSHIT YADAV :: 44 ::O.A. No. 2051/2025, 2052/2025 & 643/2022 vide Government Order No. 1513-JK(GAD) of 2022 dated 12.12.2022 to examine the alleged irregularities in the said recruitment process.
e) The Inquiry Committee thereafter conducted an examination of the recruitment process and submitted its report vide communication dated 10.02.2024. The report was followed by further communications, including an Office Memorandum issued by the General Administration Department and correspondence from the Anti-Corruption Bureau relating to the alleged irregularities in the recruitment process.
f) On the basis of the findings of the Inquiry Committee and the communications received from the Anti-Corruption Bureau, the Government issued Government Order No. 608-Home of 2025 dated 15.12.2025, whereby the services of several Fireman / Fireman Driver appointees, including the applicants in O.A. No. 2051/2025 and O.A. No. 2052/2025, were terminated on the ground that the recruitment process was allegedly vitiated by irregularities.

g) The applicants contend that the impugned termination order does not attribute any specific role, misconduct, fraud or manipulation to them individually and that their services have been terminated solely on the basis of general observations made in the inquiry report regarding the recruitment process. It is further their case that the termination order was passed without issuing any show cause notice, without framing any charges and without holding any departmental enquiry against them.
h) Feeling aggrieved by the aforesaid actions of the respondents, the applicants in the respective Original Applications have approached this Tribunal seeking appropriate reliefs including quashing of the impugned Government Order and restoration of their services with consequential benefits.
i) Since the issues involved in these Original Applications arise out of the same recruitment process, involve identical questions of fact and law, and are interconnected, all the HARSHIT Digitally signed by YADAV HARSHIT YADAV :: 46 ::O.A. No. 2051/2025, 2052/2025 & 643/2022 matters were heard together and are being disposed of by this common judgment.
3. The respondents have filed their written statement wherein they have averred as follows: -

This Hon'ble Tribunal has categorically stated that it finds no merits into the claims of the Unsuccessful candidates and had dismissed the OAs. Annexure (A-III) 26.11.2021 The Unsuccessful candidates aggrieved from the decision of this Hon'ble Tribunal filed a Writ Petition in the Hon'ble Jammu &Kashmir High Court whereby the Hon'ble High Court had also dismissed the petition on merit and further imposed a cost of ₹50,000/- Annexure (A-1V) 12.12.2022 Government Order No. 1513-JK(GAD) issued constituting an Inquiry Committee to examine allegations of irregularities. Inquiry Committee recommended Criminal Investigation in the matter through the ACB. Annexure(A-V) 02.01.2025 FIR No. 01/2025 registered by ACB, J&K based on findings of systemic manipulation in recruitment of Firemen/ Fireman Driver. b) At the outset, the respondents submit that the recruitment process for the posts of Fireman / Fireman Driver in the Fire & Emergency Services Department, Jammu and Kashmir came under serious scrutiny after complaints were received alleging large scale irregularities and manipulation in the selection process. In view of the seriousness of the allegations, the Government constituted a High-Level Inquiry Committee vide Government Order No. 1513-JK(GAD) of 2022 dated HARSHIT Digitally signed by YADAV HARSHIT YADAV :: 49 ::O.A. No. 2051/2025, 2052/2025 & 643/2022 12.12.2022 to examine the entire recruitment process and ascertain whether the selections were conducted in accordance with law.
c) It is stated that the Inquiry Committee conducted a detailed examination of the recruitment process and scrutinized the records pertaining to the selection. The Committee, after completing its investigation, submitted its report to the Government vide communication dated 10.02.2024, wherein serious irregularities and illegalities in the recruitment process were allegedly detected. The respondents further submit that the matter was also examined in light of communications received from the Anti-Corruption Bureau, which indicated that the recruitment process was tainted.
d) According to the respondents, the findings of the Inquiry Committee revealed that the recruitment process suffered from serious procedural violations and irregularities, thereby vitiating the entire selection process. In view of the said findings, the Government considered it necessary to take corrective measures HARSHIT Digitally signed by YADAV HARSHIT YADAV :: 50 ::O.A. No. 2051/2025, 2052/2025 & 643/2022 in order to maintain the integrity and transparency of public recruitment.
e) The respondents further submit that after examining the inquiry report and the related communications, the Government issued Government Order No. 608-Home of 2025 dated 15.12.2025, whereby the services of a number of appointees in the Fire & Emergency Services Department, including the applicants in O.A. No. 2051/2025 and O.A. No. 2052/2025, were terminated. The respondents contend that the said order was issued in the larger public interest in order to rectify the illegality that had crept into the recruitment process.
f) It is further the stand of the respondents that once the recruitment process itself was found to be vitiated due to irregularities, the appointments made pursuant to such a flawed selection process could not be allowed to continue. According to them, the Government was fully competent to annul such appointments in order to ensure fairness and transparency in public employment.

g) The respondents also submit that the impugned action cannot be faulted on the ground of violation of principles of natural justice, as the termination was not based on any individual misconduct of the applicants but was a consequence of the illegality detected in the recruitment process itself. Therefore, according to the respondents, the protection ordinarily available in cases of disciplinary action does not strictly apply in the present circumstances. The respondents have therefore prayed that the Original Applications are devoid of merit and deserve to be dismissed.
h) Insofar as O.A. No. 643/2022 is concerned, the respondents have additionally submitted that the recruitment process had been conducted by the competent authorities in accordance with the prescribed procedure and the selected candidates were appointed after completing the requisite selection stages. The respondents have therefore defended the selection process and have sought dismissal of the challenge raised therein.

4. The applicants have filed their rejoinder to the written statement filed by the respondents wherein they have averred as follows: -
a) In rejoinder, the applicants have denied the averments made by the respondents in their replies and have reiterated the facts and grounds taken in the Original Applications. The applicants submit that the respondents have attempted to justify an illegal and arbitrary action by relying upon an inquiry report and certain communications which were never supplied to the applicants nor were they associated with the inquiry proceedings at any stage.
b) It is contended that the appointment of the applicants was made through a duly notified recruitment process conducted by the competent authority of the Fire & Emergency Services Department. The applicants participated in the recruitment process, successfully qualified the prescribed stages including physical tests, written examination, document verification and medical examination, and were thereafter issued valid appointment orders by the competent authority. According to HARSHIT Digitally signed by YADAV HARSHIT YADAV :: 53 ::O.A. No. 2051/2025, 2052/2025 & 643/2022 the applicants, once appointments were made after completion of the recruitment process and the applicants joined service, their services could not have been terminated in such a casual and mechanical manner without following the procedure established under law.
c) The applicants further submit that the respondents have sought to justify the impugned action on the basis of the report of an Inquiry Committee constituted by the Government to examine alleged irregularities in the recruitment process. However, the applicants assert that the said inquiry was conducted behind their back and they were never associated with the proceedings of the Inquiry Committee. The findings of the Inquiry Committee were never communicated to them nor were they provided any opportunity to rebut the allegations or explain their position. According to the applicants, any action taken on the basis of such an inquiry report, without affording an opportunity of hearing to the affected employees, is violative of the settled principles of natural justice.

d) The applicants also contend that the impugned Government Order terminating their services does not attribute any specific allegation of fraud, impersonation, bribery, manipulation or misrepresentation against them individually. The termination order proceeds on a sweeping assumption that the entire recruitment process was irregular and therefore the appointments made pursuant thereto deserve to be cancelled. According to the applicants, such collective punishment without establishing individual culpability is impermissible in law and is contrary to the guarantees of equality and fairness enshrined in Articles 14 and 16 of the Constitution of India.
e) It is further submitted that the respondents have wrongly attempted to equate the present case with situations where appointments are obtained by producing forged documents or by committing fraud. The applicants maintain that they have not produced any forged or fabricated documents nor have they misrepresented any fact to secure appointment. Their selection was made by the competent authorities after conducting the HARSHIT Digitally signed by YADAV HARSHIT YADAV :: 55 ::O.A. No. 2051/2025, 2052/2025 & 643/2022 prescribed recruitment process and therefore they cannot be penalized for alleged irregularities, if any, committed by the authorities conducting the selection.
f) The applicants also submit that the inquiry conducted by the Government was merely a fact-finding exercise and cannot substitute a regular departmental inquiry as required under the applicable service rules. Termination of services of government employees without holding a proper departmental inquiry and without affording an opportunity of hearing is illegal and unsustainable in law.
g) The applicants have further contended that reliance placed by the respondents on certain judicial pronouncements to justify denial of protection under Article 311(2) of the Constitution is misplaced. According to them, the said principle applies only in cases where the employee himself has secured appointment by committing fraud or by producing false documents. In the present case, no such allegation has been levelled against the applicants.

h) It is therefore submitted that the impugned action of the respondents is arbitrary, violative of the principles of natural justice and contrary to the settled principles of service jurisprudence. The applicants have accordingly prayed that the impugned Government Order terminating their services be quashed and the applicants be reinstated in service with all consequential benefits.
5. Heard learned counsel for the parties and perused the pleadings, the documents placed on record and the material shown during arguments.
6. These three Original Applications arise out of the same recruitment process concerning the posts of Fireman/Fireman Driver in the Fire & Emergency Services Department, J&K. Since the controversy in all the matters is interconnected, the same were heard together and are being decided by this common judgment. The basic pleadings in OA No. 2051/2025 and OA No. 2052/2025 challenge the subsequent termination of the applicants pursuant to Government Order No. HARSHIT Digitally signed by YADAV HARSHIT YADAV :: 57 ::O.A. No. 2051/2025, 2052/2025 & 643/2022 608-Home of 2025 dated 15.12.2025, whereas OA No. 643/2022 had assailed the very selection process and appointments made thereunder.
7. The central question which arises for consideration is whether the applicants in OA Nos. 2051/2025 and 2052/2025 can claim continuation in service on the ground that no individual notice or departmental enquiry was held against each of them, even when the record produced by the respondents shows that the recruitment process itself stood vitiated by grave and large-scale irregularities, and whether in such circumstances OA No. 643/2022 survives for adjudication.
8. From the material placed before the Tribunal, it is evident that the Government had constituted an Inquiry Committee vide Government Order No. 1513-JK(GAD) of 2022 dated 12.12.2022 to inquire into allegations of irregularities in the selection process of Fireman/Fireman Drivers of 2020 in the Fire & Emergency Services Department. The very constitution of the Committee and the forwarding of its report for necessary action is borne out from the official record. The pleadings in OA Nos. 2051/2025 and 2052/2025 HARSHIT Digitally signed by YADAV HARSHIT YADAV :: 58 ::O.A. No. 2051/2025, 2052/2025 & 643/2022 also themselves acknowledge the constitution of this Committee, the submission of the report and the subsequent action taken by the Government.
9. The Office Memorandum of the General Administration Department placed before the Tribunal shows that the report of the Inquiry Committee was formally forwarded to the Home Department for further necessary action. The report itself, as shown from the documents produced before us, was not based on conjectures or a casual departmental suspicion. It summarized and examined inputs received from multiple agencies including ACB, Crime Branch and CID. The material shown to the Tribunal indicates complaints regarding leakage of question papers, mass copying, use of gadgets, impersonation, change in marks, suspicious concentration of selections from particular districts, selection of under-qualified or ineligible candidates, and selection of multiple close relatives from the same families and neighborhood clusters. The record further indicates that a sample scrutiny revealed a pattern too serious and too widespread to be brushed aside as isolated defects.

10. This Court cannot shut its eyes to the nature and extent of the material which has surfaced. The issue here is not of one or two doubtful appointments. The issue is not of a minor procedural lapse. The issue is whether the recruitment was so deeply contaminated that it lost the character of a fair public selection. On the material shown before us, the answer can only be in the affirmative.
11. The argument raised on behalf of the applicants in OA Nos. 2051/2025 and 2052/2025 is that no individual role of fraud has been attributed to each of them and, therefore, the impugned termination order is bad for want of prior notice and departmental enquiry. This submission, at first blush, appears attractive, but on deeper scrutiny it cannot be accepted in the facts of the present case.
12. There is a clear distinction in service law between a case where an employee is punished for his individual misconduct after entering service and a case where the very entry into service is the product of a selection process found to be fundamentally tainted. In the first category, a regular departmental enquiry is ordinarily indispensable because the employer seeks to punish a serving employee for a HARSHIT Digitally signed by YADAV HARSHIT YADAV :: 60 ::O.A. No. 2051/2025, 2052/2025 & 643/2022 specific act attributable to him. In the second category, where the selection process itself collapses because it is infected by fraud, manipulation and systemic illegality, the Government is not expected to continue the beneficiaries of such process merely because it may be difficult, after the lapse of time, to compartmentalize guilt with mathematical precision in every individual case.
13. Public employment is not a private bargain. It is a constitutional trust. Once the recruitment process is shown to have been compromised at a structural level, the State would fail in its duty if it permits such appointments to stand merely on sympathetic considerations. A candidate cannot claim an indefeasible right to continue in service on the strength of an appointment that traces its origin to a selection found to be seriously polluted.
14. The material shown to the Tribunal further indicates that this was not a case where only the "seller" of jobs acted and the "purchaser" stood wholly innocent in every case. The pattern noticed in the inquiry material, including changed or erased marks, unusual selection clusters, multiple members of the same family being selected, HARSHIT Digitally signed by YADAV HARSHIT YADAV :: 61 ::O.A. No. 2051/2025, 2052/2025 & 643/2022 allegations of leakage and under-qualified selections, points towards a scam of considerable breadth. Once the process is shown to have been manipulated at that level, the Court cannot proceed on the naive assumption that every beneficiary must still be treated as entirely insulated from the taint unless individually tried in a full-fledged disciplinary enquiry. In a recruitment scam, the first duty of the State is to restore institutional purity.
15. We are also unable to accept the submission that because some departmental officials may also have been involved, the appointees must necessarily be protected. If officials were involved, they must certainly be proceeded against in accordance with law. In fact, such officials deserve stern action. But the wrongdoing of officials does not cleanse the appointments secured through a tainted process. Illegality at one end cannot be a ground to perpetuate illegality at the other end. The argument that unless all guilty officials are first punished the beneficiaries cannot be displaced is legally untenable.
16. The applicants have also placed emphasis on the fact that some earlier challenges to the selection process had failed. This argument too does HARSHIT Digitally signed by YADAV HARSHIT YADAV :: 62 ::O.A. No. 2051/2025, 2052/2025 & 643/2022 not carry the matter any further. A selection may survive an earlier challenge on the basis of the material then available, yet later collapse when substantial additional material surfaces through vigilance or criminal inquiry. Earlier judicial orders upholding the process on a limited record do not create a permanent immunity against later administrative correction if credible and weighty material subsequently discloses that the process was in fact compromised. The pleadings themselves show that later inquiry material and communications from competent agencies formed the basis of the impugned action.
17. The applicants also urged that they were not named in any FIR and no criminal court has yet returned a finding of guilt against them. This argument again confuses two distinct spheres. Criminal prosecution proceeds on proof beyond reasonable doubt against specific accused persons. Administrative action to cleanse a tainted recruitment process stands on a different footing. The State need not await the conclusion of criminal trials extending over years before correcting a recruitment found to be constitutionally suspect. If the State were compelled to HARSHIT Digitally signed by YADAV HARSHIT YADAV :: 63 ::O.A. No. 2051/2025, 2052/2025 & 643/2022 wait for criminal convictions in every such case, no public recruitment scam could ever be corrected in time.
18. At the outset, it needs to be noticed that the Government constituted an Inquiry Committee vide Government Order No. 1513- JK(GAD) of 2022 dated 12.12.2022 to inquire into allegations of irregularities in the selection process of Fireman/Fireman Drivers of 2020 in the Fire & Emergency Services Department. The Office Memorandum placed on record further shows that the report of the said Committee was formally forwarded by the General Administration Department to the Home Department for further necessary action. The challenge in OA Nos. 2051/2025 and 2052/2026 itself proceeds on the basis that this enquiry report and the subsequent vigilance inputs formed the basis of the impugned Government Order dated 15.12.2025.
19. The enquiry material produced before the Tribunal cannot be treated as vague or inconsequential. It shows that the matter was examined not only departmentally but also with reference to inputs from the ACB, Crime Branch and CID. The material placed before us HARSHIT Digitally signed by YADAV HARSHIT YADAV :: 64 ::O.A. No. 2051/2025, 2052/2025 & 643/2022 indicates serious allegations and findings regarding leakage of question paper, use of gadgets, impersonation, change/manipulation in marks, suspicious district concentration, selection of ineligible or under-qualified candidates, and repeated selection of close relatives from the same families and local clusters. The later status material placed before us further records that 106 candidates were identified from the selection list whose result was manipulated, that questioning of all such candidates had been completed, that touts had been identified, that monetary transactions were traced, that one Maharaj Krishan Wali had admitted receipt of money through touts and accommodation of candidates in the list, and that even some employees of Fire & Emergency Services were stated to have played a role in the process. This is not a case of mere suspicion. It is a case where the State has placed before the Court a coherent body of material showing systemic corruption in the recruitment itself.
20. In such a situation, the first principle that comes into play is that fraud vitiates every solemn act. In Punjab Urban Planning and Development Authority v. Karamjit Singh, (2019) 16 SCC 782, the HARSHIT Digitally signed by YADAV HARSHIT YADAV :: 65 ::O.A. No. 2051/2025, 2052/2025 & 643/2022 Hon'ble Supreme Court reiterated the settled position that fraud destroys the very foundation of any action and no right can be claimed on the basis of a fraudulent act. Once the source itself is polluted, the benefit flowing from it cannot be protected in law. This principle applies with greater force in matters of public recruitment, because an appointment obtained through or traceable to a manipulated process is not merely an individual gain; it is a fraud upon all honest candidates who competed fairly. The Hon'ble Court further observed as follows:
"It is well settled that an order of regularisation obtained by misrepresenting facts, or by playing a fraud upon the competent authority, cannot be sustained in the eye of the law. In Rajasthan Tourism Development Corpn. Lid. v. Intejam Ali Zafris, it was held that if the initial appointment itself is void, then the provisions of the Industrial Disputes Act, 1947 are not applicable for terminating the services of such workman. In a similar case, this Court in Bank of Indiav. Avinash D. Mandivikar, held that since the respondent had obtained his HARSHIT Digitally signed by YADAV HARSHIT YADAV :: 66 ::O.A. No. 2051/2025, 2052/2025 & 643/2022 appointment by playing fraud, he could not be allowed to get the benefits thereof."
21. The second principle is that where the selection process itself is tainted on a large scale, the beneficiaries of such process do not acquire an indefeasible right to continue merely because appointment orders were issued and some period of service has elapsed. In State of Bihar v. Upendra Narayan Singh, (2009) 5 SCC 65, the Hon'ble Supreme Court clearly held that appointments made in violation of the constitutional scheme or through an illegitimate process do not create any enforceable right. The Hon'ble Court further observed as follows:-
"In our opinion, there is no merit in the submission of the learned Senior Counsel. If the initial appointments of the respondents are found to be illegal per se, the direction given by the High Court for their reinstatement with consequential benefits cannot be approved by relying upon the so-called regularisation of their services. Had the respondents been HARSHIT Digitally signed by YADAV HARSHIT YADAV :: 67 ::O.A. No. 2051/2025, 2052/2025 & 643/2022 appointed by the competent authority after issuing an advertisement or sending requisition to the employment exchange so as to enable the latter to sponsor the names of eligible persons then they would have certainly produced the relevant documents before the High Court or at least before this Court. However, the fact of the matter is that none of the documents which could give a semblance of legitimacy to the appointments of the respondents was produced before the High Court and none has been produced before this Court."
22. Similarly, in Devendra Kumar v. State of Uttaranchal, (2013) 9 SCC 363, the Hon'ble Supreme Court held that where entry into service is based on falsehood, suppression or illegality, the employee cannot seek equitable protection because the very foundation of appointment is defective. The same logic squarely extends to a case where entry is the outcome of a recruitment found to be manipulated and fraudulent. The Hon'ble Court further observed as follows: -

:: 68 ::O.A. No. 2051/2025, 2052/2025 & 643/2022 "25. More so, if the initial action is not in consonance with law, the subsequent conduct of a party cannot sanctify the same. Sublato fundamento cadit opus a foundation being removed, the superstructure falls. A person having done wrong cannot take advantage of his own wrong and plead bar of any law to frustrate the lawful trial by a competent court. In such a case the legal maxim nullus commodum capere potest de injuria sua propria applies. The persons violating the law cannot be permitted to urge that their offence cannot be subjected to inquiry, trial or investigation. (Vide Union of India v. Major General Madan Lal Yadav¹s and Lily Thomas v. Union of India19.) Nor can a person claim any right arising out of his own wrongdoing (jus ex injuria non oritur)."
23. The respondents have also relied upon State of West Bengal v. Baishakhi Bhattacharyya, 2025 SCC OnLine SC 719, on the proposition that if the recruitment process is prima facie tainted, the beneficiaries thereof cannot insist that the Court must preserve the fruits of such process in their favour. Though each case turns on its HARSHIT Digitally signed by YADAV HARSHIT YADAV :: 69 ::O.A. No. 2051/2025, 2052/2025 & 643/2022 own facts, the legal principle remains consistent: where the legitimacy of the entire process is lost, the Court cannot compel the State to continue those who came in through such process merely because individual culpability has not yet been established in a criminal trial against each one of them. The Hon'ble Court further observed as follows: -
"19. The following principles emerge from the aforesaid discussion:
When an in-depth factual inquiry reveals systemic irregularities, such as malaise or fraud, that undermine the integrity of the entire selection process, the result should be cancelled in its entirety However, if and when possible, segregation of tainted and untainted candidates should be done in consonance with fairness and equity.
The decision to cancel the selection en masse must be based on the satisfaction derived from sufficient material collected through a fair and thorough investigation. It is not necessary HARSHIT Digitally signed by YADAV HARSHIT YADAV :: 70 ::O.A. No. 2051/2025, 2052/2025 & 643/2022 for the material collected to conclusively prove malpractice beyond a reasonable doubt. The standard of evidence should be reasonable certainty of systemic malaise. The probability test is applicable. Despite the inconvenience caused to untainted candidates, when broad and deep manipulation in the selection process is proven, due weightage has to be given to maintaining the purity of the selection process.-
Individual notice and hearing may not be necessary in all cases for practical reasons when the facts establish that the entire selection process is vitiated with illegalities at a large scale."
45. The last question relates to the relief and whether it requires any modification We find no valid ground or reason to interfere with the direction of the High Court that the services of tainted candidates, where appointed, must be terminated, and they should be required to refund any salaries/paynents received. Since their appointments were the result of fraud, this amounts to cheating. Therefore, we see no justification to alter HARSHIT Digitally signed by YADAV HARSHIT YADAV :: 71 ::O.A. No. 2051/2025, 2052/2025 & 643/2022 this direction. 46. For candidates not specifically found to be tainted, the entire selection process has been rightly declared null and void due to the egregious violations and illegalities, which violated Articles 14 and 16 of the Constitution. As such, the appointments of these candidates are cancelled. However, candidates who are already employed need not be asked to refund or restitute any payments made to them. However, their services will be terminated. Furthermore, no candidate can be appointed once the entire examination process and results have been declared void.
47. Some of the appointed candidates who do not fall within the category of tainted candidates may have previously worked in different departments of the State Government or with autonomous bodies, etc In such cases, although their appointments are cancelled, these candidates will have the right to apply to their previous departments or autonomous bodies to continue in service with those entities. These applications must be processed by the respective government HARSHIT Digitally signed by YADAV HARSHIT YADAV :: 72 ::O.A. No. 2051/2025, 2052/2025 & 643/2022 departments or bodies within three months, and the candidates will be allowed to resume their positions. Further, the period between the termination of their previous appointment and their rejoining will not be considered a break in service.
24. The applicants, however, argued that Article 311(2) of the Constitution and the principles of natural justice required issuance of notice, departmental enquiry and an opportunity of hearing before passing the impugned order. This submission, though facially attractive, cannot be accepted in the factual matrix of the present case.
25. Article 311(2) protects a civil servant against dismissal, removal or reduction in rank by way of punishment. But that protection presupposes a valid entry into service. Where the very appointment is void because it was secured by fraud, falsehood or through a process that stood fundamentally vitiated, the person concerned cannot invoke Article 311(2) as if he had lawfully entered service. In R. Vishwanatha Pillai v. State of Kerala, (2004) 2 SCC 105, the Supreme Court authoritatively held that a person who obtains appointment by producing a false caste certificate cannot claim the HARSHIT Digitally signed by YADAV HARSHIT YADAV :: 73 ::O.A. No. 2051/2025, 2052/2025 & 643/2022 protection of Article 311 because such appointment is void ab initio; his termination is not punitive removal from a valid service, but merely withdrawal of a benefit wrongfully obtained. The underlying principle is not confined only to caste-certificate cases. The principle is broader: where the entry itself is non est in the eye of law, constitutional protection against punitive dismissal is unavailable because there is no lawful foundation upon which such protection can rest. The Hon'ble Court further observed as follows: -
"In Ishwar Dayal Sah v. State of Bihar the Division Bench of the Patna High Court examined the point as to whether a person who obtained the appointment on the basis of a false caste certificate was entitled to the protection of Article 311 of the Constitution. In the said case the employee had obtained appointment by producing a caste certificate that he belonged to a Scheduled Caste community which later on was found to be false. His appointment was cancelled. It was contended by the employee that the cancellation of his appointment amounted to removal from service within the meaning of Article 311 of the HARSHIT Digitally signed by YADAV HARSHIT YADAV :: 74 ::O.A. No. 2051/2025, 2052/2025 & 643/2022 Constitution and was therefore void. It was contended that he could not be terminated from service without holding departmental inquiry as provided under the Rules. Dealing with the above contention, the High Court held that if the very appointment to the civil post a is vitiated by fraud, forgery or crime or illegality, it would necessarily follow that no constitutional rights under Article 311 of the Constitution can possibly flow. It was held:
If the very appointment to civil post is vitiated by fraud, forgery or crime or illegality, it would necessarily follow that no constitutional rights under Article 311 can possibly flow from such a tainted force. In b such a situation, the question is whether the person concerned is at all a civil servant of the Union or the State and if he is not validly so, then the issue remains outside the purview of Article 311. If the very entry or the crossing of the threshold into the arena of the civil service of the State or the Union is put in issue and the door is barred against him, the cloak of protection under Article 311 is not attracted.

26. The same line of reasoning applies here. The material before us is not of a few isolated defects in an otherwise fair recruitment. The material points towards a recruitment process distorted by manipulation and organised illegality. If the process by which the applicants entered service stood corrupted at the threshold, they cannot claim that the State is still bound to treat that entry as sacrosanct and hold individual departmental trials as if their appointments were unquestionably lawful. A fraudulent or tainted entry does not ripen into a protected status merely by passage of time.
27. In Inderpreet Singh Kahlon v. State of Punjab, (2006) 11 SCC 356, the Hon'ble Supreme Court considered mass irregularities in a recruitment and discussed the circumstances in which service can be set aside when the process itself stands vitiated. The applicants may seek to rely upon that judgment to contend that individual segregation should be attempted. But that decision does not help them on the facts of the present case. That principle applies where segregation of tainted and untainted candidates is reasonably possible on a reliable basis. Here, the material placed before us indicates a deeper problem:

No. 2051/2025, 2052/2025 & 643/2022 widespread manipulation in results, involvement of touts, monetary consideration, selection of relatives, suspected tampering in OMR- related material, and irregularities extending across the structure of the selection. In such a case, insistence on microscopic individual segregation as a condition precedent to corrective action would amount to paralysing the State's power to cleanse a corrupted recruitment. Law does not require an impossible exercise where the process itself has lost credibility. The Hon'ble Court further observed as follows:
"41. If the services of the appointees who had put in few years of service were terminated, compliance with three principles at the hands of the State, was imperative viz. (1) to establish satisfaction in regard to the sufficiency of the materials collected so as to enable the State to arrive at its satisfaction that the selection process was tainted; (2) to determine the question that the dillegalities committed go to the root of the matter which vitiate the entire selection process. Such satisfaction as also the sufficiency of materials were required to HARSHIT Digitally signed by YADAV HARSHIT YADAV :: 77 ::O.A. No. 2051/2025, 2052/2025 & 643/2022 be gathered by reason of a thorough investigation in a fair and transparent manner; (3) whether the sufficient material present enabled the State to arrive at a satisfaction that the officers in majority have been found to be part of the fraudulent purpose or the system itself was corrupt."
28. There is yet another aspect. The applicants repeatedly contend that they were not personally named in any FIR and that no criminal court has convicted them. This argument confuses criminal liability with administrative invalidation of a tainted recruitment. Criminal law requires proof beyond reasonable doubt against identified accused. Administrative action to annul a corrupted recruitment stands on an entirely different footing. The State is not required to await the culmination of a criminal trial, which may take years, before restoring purity in public service. If that argument is accepted, every recruitment scam would continue to yield enforceable rights till the last criminal appeal is decided. Such a proposition is contrary to constitutional governance.

29. The applicants also urged that no specific mala fides were alleged against them individually. That again misses the real issue. The impugned action is not based on an ordinary allegation of personal misconduct committed by each applicant after appointment. It is based on the conclusion that the selection itself was the product of a manipulated and fraudulent process. When the foundation falls, the superstructure cannot survive. A candidate who has entered service through a recruitment later found to be structurally tainted cannot insist that the State must preserve his appointment until it proves his exact individual role in every detail. Such a plea, if accepted, would amount to converting a benefit derived from a tainted process into a vested right.
30. Learned counsel for the applicants also argued that earlier court proceedings had upheld the selection. In our view, that circumstance does not advance their case. A recruitment may survive challenge at one stage on the material then available, and yet subsequently collapse when substantial vigilance and investigative material surfaces. Earlier adjudication on limited material does not create perpetual immunity HARSHIT Digitally signed by YADAV HARSHIT YADAV :: 79 ::O.A. No. 2051/2025, 2052/2025 & 643/2022 against later corrective action if credible evidence thereafter discloses that the process had in fact been manipulated.
31. Much emphasis was laid on the doctrine of natural justice. There can be no quarrel with the proposition that natural justice is a foundational principle. But it is equally settled that natural justice is not an unruly horse. Its application depends upon context. Where the action is based not on individualized misconduct after lawful appointment, but on institutional invalidity of the very process of selection, and where the material indicates large-scale fraud and systemic manipulation, insistence on a full departmental enquiry against each appointee as a pre-condition for annulling the tainted recruitment would be unrealistic and would defeat public interest. The law does not compel futile formalities. The present is one of those exceptional cases where the vice is embedded in the source itself.
32. We are also unable to accept the submission that because some departmental officials may have been involved, the appointees must be protected. Erring officials, if involved, must undoubtedly be proceeded against sternly. But the involvement of officials does not HARSHIT Digitally signed by YADAV HARSHIT YADAV :: 80 ::O.A. No. 2051/2025, 2052/2025 & 643/2022 purify tainted appointments. Illegal assistance from within the system does not confer legality upon those who benefitted from it. The State would be failing in its public duty if, after detecting a scam, it proceeds only against some officials but allows the beneficiaries to continue holding public posts.
33. The Tribunal cannot ignore the rights of thousands of honest aspirants who participated in the recruitment with legitimate expectation of a fair process. A manipulated recruitment is not merely an injury to the State; it is a direct assault upon equality under Articles 14 and 16. Protecting the beneficiaries of such recruitment would mean endorsing injustice against genuine candidates who were elbowed out by fraud.
34. On an overall consideration of the matter, we are satisfied that the impugned Government Order dated 15.12.2025 was not issued in a vacuum. It was preceded by an Inquiry Committee report, followed by vigilance inputs, and supported by subsequent investigative material indicating manipulation of results of 106 selected candidates, operation of touts, monetary transactions, and involvement of HARSHIT Digitally signed by YADAV HARSHIT YADAV :: 81 ::O.A. No. 2051/2025, 2052/2025 & 643/2022 persons connected with the recruitment process. In such circumstances, the Government was justified in taking corrective action. The applicants cannot successfully invoke Article 311(2), nor can they demand continuance in service on the basis of appointments born out of a process whose legitimacy stands destroyed.
35. It was also argued that the inquiry report was not supplied and the applicants were not associated with the inquiry. We are of the view that in the peculiar facts of the present case, that contention does not alter the result. This was not a disciplinary enquiry against one or two individuals. It was an institutional fact-finding exercise into the integrity of the recruitment itself. Once the Government, on the basis of material collected from several agencies and the Inquiry Committee, reached the conclusion that the process had been rendered untrustworthy, it was open to it to withdraw the benefit flowing from such tainted recruitment. A prior personal hearing to every one of the appointees would have been an empty formality when the vice attached to the very foundation of the selection and not merely to an isolated service act after appointment.

36. The Court must also bear in mind the competing rights of the larger body of genuine candidates who participated in the recruitment. If a public selection is polluted and yet its outcome is preserved merely because some appointees have worked for some time, the greatest injustice falls upon honest aspirants who were denied fair consideration. Judicial review cannot become a shield for perpetuation of a corrupted selection at the cost of clean candidates.
37. The documents shown before us reveal that the allegations were not vague or politically motivated. There is no convincing material before us to hold that the Inquiry Committee or the agencies such as ACB, Crime Branch or CID acted with personal malice against the present applicants. No concrete plea of mala fides against the members of the Inquiry Committee has been substantiated. In absence of such material, the Court cannot discard the entire inquiry exercise merely because the result is harsh for the beneficiaries of the tainted process.
38. At the same time, we may observe that the State must carry the matter to its logical end against all concerned, including erring officials, middlemen and any private persons found involved. The cleansing of HARSHIT Digitally signed by YADAV HARSHIT YADAV :: 83 ::O.A. No. 2051/2025, 2052/2025 & 643/2022 public administration cannot stop midway. But failure or delay in taking action against some wrongdoers cannot by itself invalidate the action already taken to neutralize the tainted appointments.
39. Moreover, there is not allegation by the petitioner against the ACB officials regarding any biasness or any malafide. So, it is admitted fact that they have done it fairly and wrong persons were thrown out and thereafter by the department. In our opinion there is nothing wrong done by the department by separating bad apple from the good apple.
40. Accordingly, we hold that:
a) The recruitment process for the posts of Fireman/Fireman Driver, out of which the applicants in OA Nos. 2051/2025 and 2052/2026 came to be appointed, stood seriously tainted by fraud, manipulation and systemic irregularities.
b) Once the very foundation of recruitment is vitiated, no enforceable right to continue in service survives in favour of beneficiaries of such process.
c) Article 311(2) of the Constitution is not attracted to protect appointments which are void ab initio or are the outcome of HARSHIT Digitally signed by YADAV HARSHIT YADAV :: 84 ::O.A. No. 2051/2025, 2052/2025 & 643/2022 fraud/tainted selection. In such a case, the action is not punitive removal from a valid appointment, but withdrawal of a benefit flowing from an unlawful entry.
d) The impugned action cannot be invalidated merely because criminal prosecution against all involved persons is still under progress or because all erring officials have not yet been finally proceeded against.
e) Since it is possible to segregate the persons who were the beneficiaries of the tainted recruitment process, the decision to scrape the whole examination process is not being followed to balance equity with justice.
41. In the facts of the present case, the plea of violation of natural justice does not dislodge the impugned order, as the vice went to the root of the selection itself and not merely to isolated post-appointment misconduct.
42. For all these reasons, OA No. 2051/2025 and OA No. 2052/2025 are found to be without merit and deserve dismissal.

43. So far as OA No. 643/2022 is concerned, that OA had questioned the validity of the very same selection process and the appointments made thereunder. Since the State has already terminated the impugned appointments after enquiry into the tainted recruitment, the grievance projected in OA No. 643/2022 no longer survives for substantive adjudication. The relief sought therein stands overtaken by subsequent events. Accordingly, OA No. 643/2022 is rendered infructuous.
44. In our considered view, therefore, the challenge laid in OA No. 2051/2025 and OA No. 2052/2025 to Government Order No. 608- Home of 2025 dated 15.12.2025 is without merit. Once the recruitment process itself stood demonstrably tainted by serious irregularities of a systemic nature, the Government was justified in annulling the benefit obtained under such process. The applicants cannot claim a vested right to hold public posts born out of a selection whose fairness and credibility stand destroyed.
45. Accordingly, for the reasons recorded above:
a) O.A. No. 2051/2025 is dismissed;
b) O.A. No. 2052/2025 is dismissed;

c) O.A. No. 643/2022 is disposed of as infructuous.
46. Pending miscellaneous applications, if any, shall also stand disposed of. No order as to costs.
47. At the same time, this Tribunal cannot lose sight of the fact that a recruitment scam of such magnitude could not have taken place without the active or passive involvement of persons entrusted with the responsibility of conducting the selection process. The material placed before the Tribunal itself indicates the possibility of manipulation of the selection list, involvement of touts, receipt of illegal gratification, and suspected collusion of certain officials connected with the Fire & Emergency Services Department and the recruitment process. Public employment is a constitutional trust and any attempt to subvert it through corruption strikes at the very foundation of fairness under Articles 14 and 16 of the Constitution of India. While the beneficiaries of the tainted process cannot be permitted to retain the fruits of such illegality, it is equally imperative that those officials and intermediaries who facilitated or enabled the corruption are brought to account.

48. It has also been brought to the notice of this Tribunal during the course of proceedings that some of the officials who were connected with or responsible for the conduct and supervision of the recruitment process have not only escaped accountability so far but have, in the meantime, been granted further service benefits including promotions. Such a situation, if allowed to continue, would send a wholly wrong signal to the administration and the public at large that while the beneficiaries of the tainted process are made to suffer consequences, those who actually facilitated or enabled the corruption are allowed to go scot-free and even reap service advantages. Public administration cannot function on such inverted standards of accountability. Such act erode the faith of the General Public in system.
49. Accordingly, the competent authorities of the Union Territory of Jammu & Kashmir are directed to ensure that the investigation already initiated in the matter is taken to its logical conclusion and that all erring officials, middlemen and other persons found directly or indirectly involved in the finalization of tender, HARSHIT Digitally signed by YADAV HARSHIT YADAV :: 88 ::O.A. No. 2051/2025, 2052/2025 & 643/2022 conduct of examination and declaration of result and manipulation of the recruitment process are proceeded against strictly and expeditiously in accordance with law, including initiation of departmental proceedings as well as criminal prosecution wherever warranted. Such action shall be penal and demonstrative and shall be pursued expeditiously so that the rule of law is upheld and the integrity of public recruitment processes and public faith is restored.
50. Before parting with the matter, this Tribunal deems it necessary to observe that corruption in public recruitment is one of the gravest threats to the constitutional guarantee of equality in public employment. Recruitment to public posts must remain transparent, merit-based and free from manipulation. Any attempt to secure public employment through fraud, money or influence not only deprives deserving candidates of their rightful opportunity but also erodes public confidence in the institutions of governance. Courts and Tribunals cannot permit such tainted processes to be perpetuated or protected under the guise of technicalities. The rule of law requires HARSHIT Digitally signed by YADAV HARSHIT YADAV :: 89 ::O.A. No. 2051/2025, 2052/2025 & 643/2022 that both the beneficiaries of such fraudulent processes and the officials who facilitate them are dealt with firmly and in accordance with law so that the sanctity of public recruitment is preserved.
