RAMANNA : PRESIDENT These are the appeals filed under Section 15 of the C.P Act of 1986 by the OP 1 A.I.C of India in Complaint Nos. 363/2010, 364/2010, 365/2010, 366/2010, 367/2010, 368/2010, 369/2010, 370/2010, 371/2010, 372/22010, 373/2010, 374/2010, 375/2010, 376/2010, 378/2010, 379/2010, 380/2010 & 381/2010 pending on the file of DF, Chickmagalur being aggrieved with the common order dated 10.12.2010. As the appellant is common, consumer dispute raised, relief claimed by the complainants being identical and the matter dealt by the DF both on law and facts pertains to the said complaints being similar, in order to avoid repetition of facts and multiplicity of reasoning, all these appeals are heard together and disposed off by this common order.
The facts involved in these appeals are similar to the facts involved in Appeals Nos. 4134 to 4142/2010 & 1958 to 1989/2011 disposed off by this Commission on 18.11.2011 and Appeal Nos. 1513/2011 to 1538/2011 dated 11.01.2012. Following the said decisions and for the reasons stated therein, these appeals are also liable to be allowed. Hence, we pass the following:
O R D E R Appeal Nos. 506/2011 to 523/2011 are allowed. The impugned order passed by the District Forum is set aside.
The complaints filed by the complainants before the District Forum are dismissed. In view of the nature of dispute there is no order as to costs.
The amount deposited by the appellant before this Commission be refunded to the appellant if a memo is filed.
The original of this order is kept in Appeal No.506/2011 and a copy of it shall be placed in the rest of the files.
