Heard learned counsel for the petitioner, learned APP for the State and also learned counsel appearing on behalf of opposite party no. 2 State Bank of India through its Chief Manager, Saharsa Branch.

Call for a legible carbon copy of the case diary in connection with Sasaram P.S. Case No. 577/16, from the court of learned Chief Judicial Magistrate, Rohtas at Sasaram.

Put up immediately after receipt of the case diary. Learned counsel for opposite party no. 2 seeks time to file counter affidavit enclosing the cheque and other documents, which shall be filed in the meantime.

Learned counsel for the petitioner submits that the said cheque of Rs. 5 crores issued by HBL Power Systems Ltd. was given to one Raman Singh who works with him in his Patna High Court Cr.Misc. No.37465 of 2016 (2) dt.17-09-2016 2/2 business, namely, Manbhawan Traders who has given it to him to deposit in his account, as such, he is not concerned with the receipt of the said cheque. He submits that the petitioner is a businessman and except the present allegation he has no criminal history, as is evident from paragraph 3 of this petition. Under such circumstances, let no coercive steps be taken against the petitioner in the aforesaid case in the meantime.
