O.P.No.638 of 2023 O.P.No.638 of 2023 A.A.NAKKIRAN, J, This Petition has been filed under Section 372 of the Indian Succession Act, 1925 read with Order XXV Rule 6 of the Madras High Court Original Side Rules, 1956, to grant succession certificate in favour of the petitioners 1 and 2 on behalf of the petitioners with power to collect the debts securities and to receive the interest and dividends on and negotiate and transfer the securities specified in the schedule thereto.

2. Heard the learned counsel for the petitioners.

3.It is the case of the petitioners 1 and 2 that their brother-in-law Mr.S.Soundararajan, son of Srinivasan and paternal uncle of the 3rd to 6th petitioners aged about 93 years died intestate on 27.01.2020 and the wife of the deceased S.Soundararajan and Mrs.Indira Soundararajan who is the sister-in-law of the 1st and 2nd petitioners and paternal Aunt of the 3rd to 6th petitioners aged about 85 years died on 23.11.2021. The deceased S.Soundararajan died intestate a due and exhaustive search has been made for any last Will and Testament of the deceased and that no Will is found 1/55 https://www.mhc.tn.gov.in/judis O.P.No.638 of 2023 whereas Mrs.Indira Soundararajan died having left an unregistered Will dated 17.02.2023 only in respect of her immovable property to the 6th petitioner for which a separate probate petition had been filed by the 6th petitioner before this Court and numbered as O.P.SR.No.82369 of 2022. The unregistered last Will and Testament of Mrs.Indira Soundararajan has no specific provision or any other residual provision in the Will dated 17.02.2021 towards her estate of debts and securities. Both S.Soundararajan who died on 27.01.2020 and his wife Mrs.Indira Soundararajan who died on 23.11.2021 left the amount specified in the Schedule, within the jurisdiction of this Court.

4.The deceased S.Soundararajan married Mrs.Indira Soundararajan and has no issues during their lifetime and S.Soundararajan passed away on 27.01.2020 leaving behind his wife. The deceased S.Soundararajan had two brothers, namely, (1)Krishnaswami S.Chari and (2)Mr.Raghavan Srinivasan. Mr.Krishnaswami S.Chari was married to Mrs.Nirmala, the 1st petitioner, while their children are the 3rd and 4th petitioners. Mr.Krishnaswami S.Chari died intestate on 23.09.2017 leaving behind 1st, 3rd and 4th petitioners as his lsole legal heir. The 3rd ro 6th petitoners had 2/55 https://www.mhc.tn.gov.in/judis O.P.No.638 of 2023 gicen consent and no objection forthe issue of Succession Certificate only inthe name of the1st and 2nd petitioners. The assets in respect of which the Succession Certificate is required are of the value of Rs.24,00,11,172.31p. The 6th petitioner is the sole beneciciary of an unregistered Will dated 17.02.2021 of Mrs.Indira Soundararajan and a sepaprate petitoneor regarding the mmovable eproperty has beebn made before the High Cout for probate of the Will of the India Soundararajan, deceased with the Will annexed. Hence, the petitioners have approached this Court for grant of succession certificate in favour of the petitioners 1 and 2 on behalf of the petitioners with power to collect the debts securities and to receive the interest and dividends on and negotiate and transfer the securities specified in the schedule thereto.

5.The brother of the 2nd petitioner and the maternal uncle to the 3rd to 6th petitioners and duly representing the 3rd to 6th petitioners as their Power Agent authorised to file and given evidence in this case, was examined as P.W.1 and marked Ex.P1 to Ex.P.267.

6.P.W.1 - Mr.Sampath Srinivasan has filed his proof affidavit and had narrated the averments made in the petition stating that the petitioners have filed this petition for grant of Succession Certificate in favour of the 1st and 2nd petitioners on behalf of the petitioners with power to collect the debts securities and to receive the interest and dividends on and negotiate and transfer the securities specified in the schedule thereto. Ex.P3 is the computer generated Death certificate of Mrs.Indira Soundararajan.
