(PER : HONOURABLE THE CHIEF JUSTICE MR. BHASKAR BHATTACHARYA) Let affidavit be given by the respondent nos. 1 to 4 indicating whether the area in dispute is the common plot of the society in question and secondly, whether any permission has been given by the respondent nos. 1 and 2 for making the construction on the said common plot. Let such affidavits be given within a week.
Let the matter appear on 30th January 2014. Any construction made in the meantime, will abide by the result of this petition.
