The petitioner is seeking bail in connection with a case relating to offences punishable under Sections 147/148/149/337/427/326/307/302/34 of the Indian Penal Code, 1860.
Mr. Bikash Ranjan Bhattacharyya, learned Senior Counsel representing the petitioner submits that the said petitioner is in custody for the last 180 days after voluntarily surrendering himself. Mr. Bhattacharyya further submits that in the present case, investigation is complete and charge-sheet has been submitted. The learned Advocate representing the State also does not dispute the aforesaid submissions made on behalf of the petitioner.
Having considered the materials in the case diary and further considering the fact that trial has already commenced and four witnesses have already been examined and also taking note of the fact that this Court on the earlier occasion specifically directed completion of trial by 11th October, 2014, we are of the opinion that this is not a fit case to grant bail to the accused/petitioner at this stage specially when the time limit fixed earlier by this court for completion of the trial has not yet expired.
The application for bail is thus rejected.
The learned Judge of the court below is requested to expedite the trial and complete the same within the time limit fixed earlier by this court.
