1. Heard Sri Babu Lal Ram, learned counsel for the petitioner; Sri Suresh Singh, learned counsel for respondent nos. 4 and 5 and Sri Ashutosh Kumar Rai, learned Standing Counsel for the State-respondents.

2. Present writ petition has been filed for the following relief:

"Issue a writ, order or direction in the nature of certiorari quashing the order dated 18.09.2019 passed by the respondent no.2 in Appeal No. R18 of 2018 (Chet Ram & Ors. Vs. State of U.P.), under Section 11(1) of U.P.C.H. Act related to Village- Gautam Budh Nagar (contained as Annexure No.12 to this writ petition)."

It is undisputed between the parties that by order dated 18.09.2019, the Settlement Officer, Consolidation, Gautam Budh Nagar, has allowed the recall application filed by the Yamuna Expressway Industrial Development Authority (YEIDA). The petitioner has not filed any revision against that order and also the appeal thus restored is still pending.

4. In view of the above, the prayer made may not be granted by this Court in face of alternative remedy against the order dated 18.09.2019 and in view of the appeal preferred by the petitioner being still pending. However, it is expected that the appeal authority shall proceed to hear and decide the appeal on its own merit, as expeditiously as possible, without allowing for any undue or long adjournment to either party.

5. Present writ petition is thus disposed of.
