ORDER
Writ Petition has been filed seeking to issue a Writ of Certiorari to call for the records of the proceedings in Crime No.3 of 2019 dated 22.06.2019 on the file of the third respondent and to quash the same as illegal and without jurisdiction.
2.There is no representation for the petitioners.
3.It is the case where First Information Report was registered against the writ petitioners herein alleging breach of trust, cheating and violation of Chit Funds Act. The First Information Report was registered on 22.06.2019 for the alleged offences under Sections 406 and 420 of IPC and Sections 3 and 4 of the Prize Chit and Money Circulation Schemes (Banning) Act, 1978. The 1st petitioner is the company and the four others, who were handling the affairs of the said company are arrayed as accused.

4.This writ petition was filed by the company and one of the accused by name Ramesh for a relief to issue a Writ of Certiorari and quash the proceedings in Crime No.3 of 2019 dated 22.06.2019. Initially, this Court has passed an interim order on 27.08.2019 appointing a Committee headed by a Retired High Court Judge to oversee the disbursement of the money to the depositors. At the time of passing this order, it was projected by the petitioners that only 365 depositors ought to be settled and the amount liable to be settled is only around Rs.11,55,56,260/-. However, the Committee, which was vested with the responsibility of disbursement of money found that there are nearly 80,000 claimants and the amount payable by the petitioners runs to several hundred crores of rupees.

6.Thereafter, this Court, on taking note of the fact that the petitioners have collected huge deposits in the southern States of the Country like Kerala, Karnataka, Pondicherry and TamilNadu by appointing Agents. They have collected about Rs.1000 crores as deposits from 73,000 depositors and therefore, it will be appropriate to constitute a fresh Committee to redress the grievance of the depositors.
7.Accordingly, a new Committee was constituted naming a Retired High Court Judge and he was permitted to have assistance of four Advocates and Retired District Judge of his choice. This order was 116/122 https://www.mhc.tn.gov.in/judis W.P.No.24057 of 2019 and W.M.P.Nos.4510 of 2022, 6351 of 2022, 9743 of 2022 and 5948 of 2022, 26959 of 2019, 4974 of 2022, 17915 of 2020, 9745 of 2022, 5946 of 2022, 9747 of 2022, 8120 of 2022, 9742 of 2022, 2965 of 2022,23880 of 2019, 9740 of 2022, 9746 of 2022, 2296 of 2022, 11160 of 2022, 9739 of 2022 passed by this Court on 04.02.2022. This Court received a memo dated 24.03.2022 filed by the former Judge of this Court, who was appointed as a Chairman. In the said a memo dated 24.03.2022, the Hon'ble Judge has expressed his unwillingness to accept the assignment due to personal reasons.
8.The writ petition filed under Article 226 of the Constitution of India seeking Certiorari and quashing the First Information Report as by entertaining it had given a protective umbrella to the accused persons and had taken a different dimension deviating the investigation of the crime perpetrated to have been committed by the petitioners herein.
9.A fraud of huge magnitude running to 1000 crores collected from nearly 73,000 depositors across the country has been side tracked through this writ petitioners and as rightly pointed out by the learned counsel appearing for the depositors, the investigation has not been 117/122 https://www.mhc.tn.gov.in/judis W.P.No.24057 of 2019 and W.M.P.Nos.4510 of 2022, 6351 of 2022, 9743 of 2022 and 5948 of 2022, 26959 of 2019, 4974 of 2022, 17915 of 2020, 9745 of 2022, 5946 of 2022, 9747 of 2022, 8120 of 2022, 9742 of 2022, 2965 of 2022,23880 of 2019, 9740 of 2022, 9746 of 2022, 2296 of 2022, 11160 of 2022, 9739 of 2022 progressed nor the money recovered. The money received as deposits has been laid at unknown place. The investigating agency has not made any attempt to lay their hands on the said money or assets.
10.Therefore, this Court is of the view that the Constituted Committee to disburse the money even before recovery of the substantial money alleged to have been cheated is too pre-mature.
11.In the given circumstances, this Court, vide order dated 04.02.2022 had directed the State to form a Special Investigation Team/Wing headed by Senior Superintendent of Police and speed up the investigation. 12.The learned Government Advocate (crl.side) submits that sofar through the investigation 19 properties worth around Rs.55 crores and 30 bank accounts operated by the accused persons were identified and freezed by the Income Tax Department and Customs Department.
13.This Court, on going through the Status Report on 10.01.2022 filed by the investigating officer, finds that around 36 complaints sofar registered at various police stations in southern states namely, Kerala, Karnataka, Pondicherry and Tamil Nadu.
14.Considering the gravity of the crime, the magnitude of the offence and number of general public affected, the progress in the investigation action taken sofar to say the least is deplorable. 15.Hence, the State is hereby directed to constitute a Special Investigation Team as early as possible and proceed with the investigation and also complete the same at the earliest.
16.For the reasons and discussions made above, the quash petition carries no merits and deserves to be dismissed. Accordingly, this Writ Petition is dismissed. No order as to costs.
17.In view of the disposal of the main writ petition, all the impleading petitions are dismissed with a liberty to approach the Investigating Officer and record their claim for proper investigation. No costs.
