% 05.08.2021 [Court hearing convened via video-conferencing on account of COVID-19]

1. Mr. N.K. Singh, who appears on behalf of the respondents, says that all posts in the category of Physically Handicapped (Orthopaedically Handicapped) [in short "PH (OH)"] have been filled up. In this behalf, Mr. Singh has drawn our attention to the averments made in the counter- affidavit.

2. On the other hand, Ms. Pragnya Routray, who appears on behalf of the petitioner, has drawn our attention to the advertisement, wherein it is, inter alia, stated that 30 posts were advertised in the category of PH (OH) [See page 57 of the paper book].

2.1. Ms. Routray has cross-referenced this, with the document appended on page 81, which shows that 12 candidates under PH (OH) category were selected.

2.2. Furthermore, Ms. Routray says that the Tribunal, had passed an interim order dated 11.10.2017, whereby, one post for the petitioner under TGT (Computer Science) had been directed to be reserved. Ms. Routray says, this interim order continued till the final order was passed by the Tribunal on 05.03.2020.

3. Mr. N.K. Singh will obtain instructions with regard to the aspect brought to our notice by Ms. Routray, i.e., as to whether or not any vacancies qua the subject post are available at this juncture.

4. We are also informed that a fresh advertisement was taken out by the respondents on 04.01.2020, where 11 posts in TGT (Computer Science) PH (OH) category were advertised. Ms. Routray says that the exam qua the said advertisement is slated to be held on 07.08.2021.

5. List the matter on 12.08.2021.
