SANJEEV KAUSHIK, MEMBER (J):-
1. With the consent of learned counsel for the parties, both these OAs i.e. O.A. No.60/629/2019 and O.A. No.60/630/2019 are taken up for final hearing.
2. M.A. No.60/2000/2019 has been filed by the applicants in O.A. No.60/629/2019, with a prayer to restrain the respondents from filling up vacancies notified vide advertisement dated 9.12.2019. In O.A. also since challenge is to letter dated 24.4.2019 (Annexure A-8) to the extent of making fresh appointment on contract basis by outsourcing candidates through GEM and replacing the applicants, who are contractual employees, with same set of contractual employees, is illegal and in violation of Articles 14 and 16 of the Constitution of India.
3. Learned counsel for the respondents seeks permission to file reply to M.A. in the Court. Allowed. The same is taken on record. Based upon the reply, learned counsel submitted that in terms of Annexure R-2, decision dated 26.11.2019 by Govt. of India, Ministry of Labour and Employment, they have decided to fill up these vacancies from outsourcing through "Aman Securities and Detectives" for a period of four months w.e.f. 01.12.2019 to 31.3.2020. 13
4. Sh. Amit Takhi, learned counsel for the applicants vehemently argued that the method adopted by the respondents is contrary to undertaking before this Court and subsequently OM dated 28.3.2018 (Annexure A-7), wherein in earlier round of litigation when services of the applicants were dispensed with on completion of contract period, respondents suffered a statement that whenever, they will receive sanction/approval for filling up these posts, claim of the applicants, who were working on those posts on contract basis and had acquired experience, would be considered.
He further argued that method adopted by the respondents in filling up these vacancies by ignoring the claim of the applicants and through outsourcing is contrary to ratio laid down by the jurisdictional High Court in the case of Shiv Kumar and another vs. State of Haryana and another, 2017 (2) RSJ 333, where similar method adopted by the State of Haryana has been deprecated and it has been held that one set of contractual employee cannot be replaced by another. Thus, applicants in these cases cannot be punished by filling up the posts by outsourcing. Therefore, he prayed that action of the respondents be stayed.
5. Sh. Sanjay Goyal, appearing on behalf of the respondents argued that since a decision has been taken by the 14 respondents to fill up these vacancies from outsourcing and as such applicants can approach contractor, therefore, their plea for stay be dismissed.

In the wake of the above indicated facts, coupled with the judgment passed by the jurisdictional High Court in similar circumstances, I am of the considered view that applicants have a prima facie case in their favour and balance of convenience also lies in their favour for restraining the respondents from filling up these vacancies from outsourcing. Accordingly, it is ordered that if respondents actually are in need of candidates, then they are directed to consider claim of the applicants, who have earlier worked against those vacancies, in the first instance, if they are otherwise suitable and have not acquired ineligibility.
7. In view of the fact that prayer of the applicants in both the O.As is also identical to the one made in M.A. for restraining the respondents from filling up vacancies through outsourcing, both the OAs along with all the pending MAs stand disposed of in the above terms. No costs.
