1. This Original Application was registered on a letter petition dated 08.05.2022, sent by Syed Riyaz, R/o 51 Gulposh Colony near Aamina Hospital & Nursing Home, National Highway, Chanpora Bypass, Srinagar (Kashmir)raising a grievance that in District Budgam, about 200 brick kilns are operating illegally and unauthorizedly, causing damage to environment. These brick kilns have no consent/clearance from the concerned Statutory Regulators under environmental laws, using unscientific Chimney System which causes clouds of smoke and scatter dust particles and thereby, cause air pollution resulting in health hazard to local residents.
2. Tribunal considered complaint on 19.09.2022 and found it appropriate to constitute a Joint Committee comprising State PCB, Food and Civil Supplies Department, Union Territory of Jammu & Kashmir, Deputy Commissioner, Budgam and Union Territory of Jammu and 1 Kashmir and directed it to submit factual Report by verification of facts stated in the complaint.
3. Tribunal also impleaded Union Territory of Jammu and Kashmir through Chief Secretary, J&K State Pollution Control Committee (hereinafter referred to as 'JKPCC') and Deputy Commissioner, Budgam as respondents 1 to 3. Notices were issues to said respondents also.
4. Pursuant to order dated 19.09.2022, Joint Committee filed Report dated 09.01.2023 stating that a large number of brick kilns were operating without requisite permissions/licenses. Some of such brick kilns were demolished by District Administration but some approached High Court in which interim protection was given by passing status quo order.
5. Above Report was taken up in the proceedings stated 14.07.2023,and observing that some brick kilns are operating illegally, direction was given to JKPCC to take action in accordance with law and not to allow any brick kiln expansion or functioning without ensuring compliance with environmental laws and also availability of carrying capacity to maintain ambient air quality norms. JKPCC was directed to submit a further Report within two months.
6. Accordingly, an action taken Report dated 19.04.2023 was filed by JKPCC through its Member Secretary. He gives status of 213 brick kilns in Budgam district as under:

7. It is stated at page 37 in para (b) that out of 213 brick kilns located in Budgam District, status of consent issued by JKPCC to brick kilns in Budgam District as on 13.04.2023 is as under (only the cases which fulfil the guidelines/siting criteria of Brick Kilns):
"Consent to Operate/Renewal granted =77 Consent to Establish (New) granted =04 Consent cases rejected =05"
8. It is also said that Regional Director, JKPCChas issued 96 notices to brick kiln owners who have not got their Consent to Operate (hereinafter referred to as 'CTO') renewed.
9. As on 31.03.2023, 46 brick kilns were not complying with environmental norms.
10. Thereafter, a further Status Report dated 04.10.2023 was filed, giving status of 226 brick kilns of district Budgam in the form of chart as under:

2. In compliance to Hon'ble NGT directions in this regard, no new brick kilns in Budgam District are accorded Consent to Establish by J& K Pollution Control Committee till further directions from Hon'ble National Green Tribunal.
3. All the existing Brick Kilns have been brought under the ambit of Consent mechanism strictly in accordance with the conditions stipulated in the Ministry of Environment and Forests & Climate Change, Govt. of India notification vide GSR 143(E) dated 22.02.2022 and in compliance to the Hon'ble High Court of J & k order dated 20.02.2022 and in compliance 6 3to the Hon'ble to the High Hon'ble High Court of J& K Order dated 20.10.2021 in PIL No.22/2016 and order dated 26.07.2022 in WP (C) No.1117/2022.
Hence, the Status Report of J&K Pollution Control Committee my kindly be taken on record and paced before Hon'ble NGT for consideration please."

11. Tribunal considered matter on 05.10.2023 and found it appropriate to direct JKPCC to give compliance status in respect of all the brick kilns working in Union Territory of Jammu and Kashmir.
12. Pursuant thereto, additional Report dated 03.01.2024 was filed stating that total 560 brick kilns are existing in Jammu and Kashmir where against 415 have obtained/applied for consent, 201 brick kilns have converted to zig-zag technology as on 31.12.2023, and directions have been issued for closure of 125 brick kilns for violation of environmental laws.
13. The Committee also referred to certain directions issued by High Court of Jammu and Kashmir and orders of NGT in respect of functioning of brick kilns which are as under:
"Compliance to the Hon'ble High Court Orders/NGT w.r.t. brickkilns:
1. In compliance to Hon'ble High Court of J & K orders from time to time brick kiln within 08 kms radius of Srinagar Airport runway are not permitted to function from November 1st to March 31st.
2. 85 non complying Brick Kilns have been ordered to be closed by the J & K being implemented by the District Administration Budgam.43
3. No new Brick Kilns in Budgam District are accorded Consent to Establish by J & K Pollution Control Committee till further directions fromHon'ble NGT.
4. J & K Pollution Control Committee is in the process of compiling the latest latest status of all Brick Kilns in UT of Jammu & Kashmir. Bases on the status following actions are contemplated over the next three months.
a) Directions under Air Act, 1981 will be to shut down the operation of such Brick Kilns that do not have a valid Consent.
b) In10kmsradiusofnon-attainmentcities of Jammu/Srinagar, Brick Kilns without Zig-Zag Technology shall not be permitted to operate beyond February 2024.
c) In rest of the area (other than non-attainment cities the brick kilns shall be directed convert to Zig-Zag Technology by or before February, 2023).
Hence the Additional report of J & K Pollution Control Committee may kindly be taken on record and placed before the Hon'ble NGT for consideration please."
14. Tribunal vide order dated 04.01.2024 directed all concerned District Magistrates and Superintendents of Police to ensure that no brick kiln is allowed to set up and operate without obtaining consent from JKPCC or without compliance with environmental norms.
15. Pursuant to said order,a compliance status Report dated 20.01.2024 was filed, giving compliance status as on 20.01.2024 as under:
"1. The Summary of updated compliance status of all Brick Kilns in J&K as on20-01-2024 is as follows:
i) Total No. of Brick Kilns in J&K - 570.
ii) Brick Kilns functional with Consent - 196.
iii) Brick Kilns without Consent - 132
iv) Closure orders by J&K Pollution Control Committee- 46.
v) Brick Kilns applied for Consent and is under process at various stages for accord of consent- 147.
The detailed list of compliance status of all Brick Kilns in J&K is appended as Annexure 'A' and list of closure orders is appended 44 as Annexure 'B' and list of brick kilns applied for consent is appended as Annexure 'C'.
2. The Consent Status of all Brick Kilns of J&K have been uploaded on the official website of J&K Pollution Control Committee i.e. https://jkpcc.nic.net.in as on 20-01-2024 (Scroll on main page and under information>General information>Public notice>Consent Status of Brick Kilns in UT of J&K).
3. Directions under Section 31 (A) of Air (Prevention and Control of Pollution)Act, 1981 have been to all the District Magistrates (DMs) to ensure that no Brick Kilns is setup and operated without obtaining CTE/CTO from JK PCC and without due compliance with environmental norms. Copy of directions to District Magistrates (DMs) is appended as Annexure 'D'.
4. A public notice has been in local dailies of J&K for the attention of Brick Kiln owners of J&K to comply with the environmental norms. Copy of Public notice is appended as Annexure 'E'.
5. In l0 kms radius of Non-Attainment Cities of Jammu/Srinagar, Brick kilns without Zig-Zag Technology shall not be permitted to operate beyond February2024.
6. In rest of the area (other than Non-attainment Cities) the Brick Kilns shall be directed to convert to Zig-Zag Technology by or before February 2025."
16. Tribunal observed that despite the orders passed by Tribunal that no brick kiln should be allowed to operate illegally i.e., without consent and in violation of environmental laws still some brick kilns are operating in violations. Therefore, response from Principal Secretary, Department of Environment was required on this aspect vide order dated 02.02.2024.
17. Pursuant thereto, a compliance Status Report dated 06.04.2024 was filed, giving compliance status as under:
"1. The updated status of brick kilns in the UT of Jammu and Kashmir is summarized here as under:-Total number of the Brick kiln in J & K 570

i) Brick Kiln Functional with Consent to Operate (CTO) 203

2. That, out of 570 brick kilns in the Union Territory of Jammu and Kashmir, 205 Brick Kilns are consented and are in operation with valid consent of the J& K Pollution Control Committee and in remaining 365 brick kilns, there are different categories viz. 122 brick kilns those have not kilns those who have not obtained Consent and have ordered to be closed by the J & K PCC and in remaining 243 brick kilns there are 238 brick kilns those who have obtained consent earlier but have not renewed their consent under provision of Water/Air Acts have also been closed by the J & K PCC till they get their consents renewed and in 05 cases, consent have been refused for not following norms. It is to mentioned here that all these 243 brick kilns are also ordered to be closed till they renew their consent following environmental norms. The updated status of brick kilns is appended as Annexure (A).
3. That regarding implementation status of closure order, out of 365, closure orders in respect of the brick kilns which were operating without consent, 326 closure orders as per the reports of respective Regional Directors and Divisional Officers stands implemented. Remaining 39 brick kilns out of the brick kilns in respect of which closure orders have been in first week of April 2024 are in the process of implementation through the respective District Magistrates. However, it is learnt that no brick kilns is currently functional.
4. That the Consent Status of all Brick Kilns of J & K has been uploaded on the website of J & K Pollution Control Committee i.e., https://jkpcc.nic.net.in (scroll on main page and under information >General information>Public notice>Consent Status of Brick Kilns in UT of J & K). The status is regularly updated as & when consent is renewed.
5. That, Directions under Section 31 (A) of Air (Prevention and Control of Pollution) Act, 1981 have been from time to time to all the District Magistrates (DMs) to ensure that no Brick Kiln is setup and operated without obtaining mandatory Consent to Establish and Consent to Operate from JK PCC and without due compliance with environmental norms. The latest directions to all the District Magistrate as on 01.04.2024 for ensuring that no brick kilns is allowed to operate without having valid consent from J & K 46 Pollution Control Committee. Copies of directions to District Magistrates (DMs) are appended as Annexure 'B'.
6. That in order to have a proper check and control. On the defaulting brick kilns, Divisional Officers J&K PCC have been instructed through respective Regional Director vide letter No..JKPCC/NGT/I30/719 dated 30-03-2024 to ensure that no Brick kiln in respect of which closure order has been is allowed to operate, and in case if any violation is noticed, the Divisional Officer concerned shall immediately report the same to the District Magistrate, superintendent of police of the District, Member Secretary. Further, the Divisional Officer shall also ensure filing of the complaint against the occupier of the Brick kiln in the court without any delay. The copy of the instructions is appended as Annexure (C).
7. That, a Public notice has also been in local dailies of J&K for the attention of Brick Kiln owners of J&K to comply strictly with the environmental norms and adhere to the notification GSR 143 (E)Dated 22ndFebruary 2022 by MoEF&CC read with notification GSR 895(E) Dated 15thDecember 2023 which reads as under.
Copy of Public notice is appended as Annexure D.
i) That, in 10 kms radius of Non-attainment cities of Jammu/Srinagar, Brick kilns without Zig-Zag Technology shall not be permitted to operate beyond February, 2024.
ii).That, in rest of the area (other than non-attainment cities) the brick kilns shall be directed to convert to Zig-Zag Technology by or before February, 2025."
18. Special Secretary (Technology), Forest, Ecology and Environment Department also filed separately action taken Report on 01.05.2024, pointing out contradictory facts submitted by JKPCC.
19. It also stated that action has been taken for proper functioning of Pollution Control Committee which is as under:
"VII Action taken for proper functioning of J&K Pollution Control Committee
a) The Law Officer of the JKPCC, while appearing virtually on behalf of the Member Secretary JKPCC before the Hon'ble National Green Tribunal on 2- 2-2024, had, interalia, stated:47
".....that Member Secretary, J&K PCC has been transferred and two Regional Officers have also been transferred. Therefore, for want of any competent officer he is appearing virtually representing J&KPCC....."
b) Based on the above submissions of the Law Officer of the JKPCC, the Hon'ble National Green Tribunal had observed:
".....This reflects sorry state of affairs showing that there is no responsible officer available in the J&K PCC....." and had accordingly directed:
"....... Principal Secretary, Department of Environment, J&K requiring him to file , response disclosing action taken for proper functioning of J&K PCC...."
c) It is respectfully submitted that the above statement of Law Officer of the JKPCC, before the Hon'ble National Green Tribunal on 2.2.2024is factually incorrect and misleading.
d) While the then Member Secretary, J&K Pollution Control Committee was transferred vide Government Order No.31- JK(FST) of 2024 dated 31.01.2024 (copy attached as Annexure- VI), he handed over the charge of Member Secretary, J&K Pollution Control Committee to the Chairman, JKPCC only on 5/2/2024 (copy attached as Annexure-VII). Similarly, the two regional directors were also transferred in the same order, and their substitutes provided.
They were also available on 2.2.2024, contrary to the submissions of the Law officer. The new Member Secretary, J&K Pollution Control Committee has also joined on 15.3.2024.
e) Therefore on 2.2.2024, when both the Member Secretary, J&K PCC and the Chairman, J&K PCC were available in the J&K PCC HQs, and the two regional directors in the field, the above statement of the Law Officer before the Hon'ble National Green Tribunal is factually incorrect and misleading. The transfer of officers cannot be or was never the reason for non-compliance of the directions of the Hon'ble Tribunal by the J&K PCC, regarding the closure of the non-consented brick kilns. The Chairman, J&K PCC has separately been asked to explain/clarify these submissions of the Law Officer and as why neither the Member Secretary, J&K PCC nor the Chairman, J&K PCC were present before the Hon'ble National Green Tribunal on 2.2.2024, despite its directions. He has also been asked to explain the reasons for the repeated noncompliance and inordinate delay on the part of J&K PCC in complying with the directions of the Hon'ble Tribunal regarding the closure of the non-consented brick kilns (copy attached as Annexure-VIII) 48
f) As regards the directions of the Hon'ble National Green Tribunal for properfunctioning of the J&K PCC it is respectfully submitted that all seniorofficers/officials of the J&K PCC are in place, as per details given inAnnexure-IX. Recently, transfers of all senior officers have also been affectedin the J&K PCC after a gap of 5 years. A copy of the order is attached atAnnexure-X. An exercise for reorganization and revision of the RecruitmentRules of the J&K PCC has also been initiated, about six months back, toprofessionalize the organization."
20. In this backdrop, Tribunal required presence of Principal Secretary, Department of Environment and Member Secretary, JKPCC, through virtual mode for assistance.
21. Again Status Report has been filed on 17.05.2024, giving status of various brick kilns of Union Territory of Jammu and Kashmir as under:
"Status Report:
That the current status of the Brick Kilns in the UT of Jammu and Kashmir as on 16-05-2024 along with previous status as stood on 05-4-2024 is given below in the tabulated form :-

Referring to the directions of Hon'ble National Green Tribunal, the respective District Magistrate were directed to ensure that i) no brick Kiln is allowed to operate without valid Consent from the J&K Pollution control committee and ii) brick Kilns operating without valid Licenses from the Licensing Authority and without valid consent from J&K Pollution control committee are closed immediately. Copies of the directions and communications are enclosed as Annexure 1 to 3.
Directions to the District Magistrate Annexure-1 dated 18.01.2024 Directions to the District Magistrates Anneuxre-2 dated 14.02.2024 Directions to the District Magistrates Annexure-3 dated 14.02.2024 That instructions were to the Regional. Directors / Divisional Officers of J&K Pollution Control Committee to ensure that brick kilns without Consent to Operate (Renewal) must not be allowed to operate and in case any brick kiln is found operating in violation of the orders of Hon'ble NGT, compliant may be filed in the competent court having jurisdiction under the relevant provisions of Water (Prevention and Control of Pollution) Act, 1974 and Air (Prevention and Control of Pollution) Act, 1981. Furthermore, the Divisional Officers in the Districts have also been advised to maintain close and strict vigil on the activities of the brick kiln units and work in co-ordination with the District Administration. Copy enclosed as Annexure- 4.
That after site verifications conducted by the respective Divisional. Officers of J&K Pollution Control Committee, the Divisional Officers have reported that pursuant to issuance of closure orders, the brick kilns are not functioning except those listed below. Copies of the 50 reports of Regional Director, J&K PCC Jammu and Kashmir are enclosed as Annexure - 5 & 6).
That the Divisional Officer, J&K PCC Jammu and Samba reported that following 2l brick kilns (16) Jammu District and 5 Samba District) had resumed their operations despite closure:-

The copies of the communications to the Deputy Commissioner, Jammu and Samba along with list of brick kilns are enclosed as Annexure-7 &B.The respective Deputy Commissioners took note of the communication of J&K PCCand further instructed the Tehsildars concerned to stop the unauthorized operation till the permission from the competent authority is granted in their favour. Copies enclosed as Annexure - 9 & 10.
That the J&K PCC also took the cognizance of the violations and complaints under Section 37 of Air (Prevention & Control of Pollution) Act, 1981 read with Section 41 of Water (Prevention & Control of Pollution) Act, 1974 for violations of the directions under Section 31 (A) and 33 (A) are being filed through the respective Divisional Officers in the Courts of respective Chief Judicial Magistrates of Jammuand Samba respective[y for further necessary actions, copies enclosed as Annexure - 11 & 12.
That, a brief note on the status of functioning of J&K PCC is also enclosed herewith for kind perusal of the Hon'ble Tribunal at Annexure-13."
22. Financial Commissioner (Additional Chief Secretary) has also filed separately an action taken Report dated 20.05.2024, wherein it has summarized all earlier Reports and action taken from time to time as under:
"VI) It is respectfully submitted that in terms of the above directions of the Hon'ble National Green Tribunal requiring the Principal Secretary to file the response, the JKPCC was requested to furnish the details of the status for fresh compliance. However, as was observed by the Hon'ble National Green Tribunal in its order dated 05.10.2023 and 04.01.2024 and despite repeated instructions and meetings by the Administrative Department, the position as submitted by the J&K Pollution Control Committee, initially on 27.03.2024, 01.04.2024 and 04.04.2024 was again incomplete and contradictory.
a) It is respectfully submitted that in its reply filed before the Hon'ble National Green Tribunal on 20-01-2024, the JKPCC had, inter alia, stated:
".......1. The summary of updated compliance status of all Brick Kilns in J&K, as on 20-01-2024, is as follows:
i)Total No. of Brick Kilns in J&K -570
ii) Brick Kilns functional with Consent - 196
iii) Brick Kilns without Consent - 132
iv) Closureorders by J&K Pollution Control Committee - 146.52
v) Brick Kilns applied for Consent and is under process at various stages foraccord of consent-- 147.
The detailed list of compliance status of all Brick Kilns in J&K is appended as Annexure 'A' and list of closure orders is appended as Annexure 'B' and list of brick kilns applied for consent is appended as Annexure 'C'...."
As would be apparent from the above, only 196 were reported to have Consent out of a total of 570 Brick Kilns in J&K. Clearly, 374 (570-196) Brick Kilns were without consent, and not 132, as stated above at S No (iii). Out of these 374, closure orders were to only 146, for reasons not stated. Whether 146 Brick Kilns, against whom closure orders were issued, were closed and not actually operating on ground was also not reported.
b) The J&K PCC vide their communication dated 27.3.2024 (copy attached as Annexure-I), in response to the Administrative Department's communication for a fresh/complete status, informed:
"(i).... That the operation of Brick Kilns in the UT of Jammu & Kashmir is being regulated by the District Magistrates and J&K Pollution Control Committee as per the provisions laid out in the following legal enactments and guidelines by the Government of India and Government of J&K from time to time.
1. Siting criteria for New Brick Kilns 2004.
2. Guidelines for regulations of Brick Kilns 2010.
3. The Jammu and Kashmir Brick Kilns (Regulation) Act 2010.
4. The Jammu and Kashmir Brick Kilns (Regulation) Rules, 2017.
5. Operational Guidelines for Brick Kilns in J&K, 2021.
6. Environment (Protection) Amendment Rules, 2022 dated 22ndFebruary 2022.
7. Environment (Protection) Sixth Amendment Rules, 2023 dated 15thDecember 2023.
ii. That, out of 132 Brick Kilns without Consent, 09 nos of Brick Kilns have been accordedconsent to operate and for remaining 123 nos of Brick kilns, closure orders stand iii. That the Consent Status of all Brick Kilns of J&K has been uploaded on the website of J&K Pollution Control Committee i.e. https://jkpcc.nic.net.in (Scroll on main page and under information >General information>Public notice>Consent Status of Brick Kilns in UT of J&K). The status is regularly updated as & when consent is /renewed.
iv. That, Directions under Section 31 (A) of Air (Prevention and Control of Pollution) Act, 1981, have been to all the District Magistrates (DMs) from time to time to ensure that no Brick Kiln is allowed to 53 set up and operate without obtaining consent from the Pollution Control Committee and those brick kilns found operating without valid licenses from the Licensing Authority and without valid consent from J&K Pollution Control Committee shall be closed immediate forthwith. (Copies are attached herewith.
v. That, a public notice has also been in local dailies of J&K for the attention of Brick Kiln owners of J&K to comply strictly with the environmental norms and adhere to the notification GSR 143 (E) Dated 22ndFebruary 2022 by MoEF&CC read with notification GSR 895(E) Dated 15thDecember 2023 which reads as under.
i) That, in 10 kms radius of Non-Attainment Cities of Jammu/Srinagar, Brick kilns without Zig-Zag Technology shall not be permitted to operate beyond February 2024.
ii) That, in rest of the area (other than Non-attainment Cities) the Brick Kilns shall be directed to convert to Zig-Zag Technology by or before February 2025.
The J&K PCC, as would be apparent from above, provided information with respect to only 132 brick kilns who have never applied nor obtained Consent to operate their brick kilns. Out of 132, 09 nos of Brick Kilns have been accorded consent to operate and for the remaining 123 nos of Brick Kilns closure orders stands issued. However, J&K Pollution Control Committee was silent about the status of all other Brick kilns established in the UT of Jammu and Kashmir whether they are functional/non-functional and have consent to operate/establish or not. The J&K PCC was again requested to clarify and submit full details.
c) The J&K PCC vide their communication dated 1.4.2024 (copy attached as Annexure-II) informed:
"........That, the Regional Director's, Jammu/Kashmir and the concerned Divisional Officers of the Districts have also been directed to ensure that no brick kiln in respect of which closure orders have been is allowed to operate in violation of environmental laws and in case of any violation, the Divisional Officers has been directed to report the matter to the District Magistrate, SSP of the District and Member Secretary, J&K PCC. The Divisional Officers have also been asked to ensure filing of complaint against the occupier in the Court of law without any delay (Copy enclosed).
Furthermore, the District Magistrates of the concerned Districts have been again directed to ensure that no brick kiln is allowed to set up and operate without obtaining valid consent from the Pollution Control Committee and those brick kilns found operating without valid licenses from the Licensing Authority and without valid consent 54 from J&K Pollution Control Committee shall be closed immediate forthwith (Copy enclosed)....
The J&K PCC again failed to provide the full details. Chairman J&K PCC and Member Secretary J&K PCC were called for discussion on 1.4.2024 again and directed to ensure compliance and share full details.
c. J & K Pollution Control Committee vide another reference No.JKPCC/NGT/130/3025 dated 04.04.2024 has furnished the additional information regarding status of brick kilns in UT of Jammu and Kashmir and the same is given as under:

Thereafter, J & K Pollution Control Committee vide another reference No.JKPCC/NGT/130/3027 dated 04.04.2024 furnished the updated status of brick kilns in the UT of Jammu and Kashmir and the same is reproduced as under:1. Total number of the Brick Kilns in J & K 570
2. a) Closure orders to the Brick Kilns were 123 operating without consent
b) Closure orders to Brick Kilns whose validity 155 55 expired 3. Total closure order 278 4. Brick Kilns consented 292
a)Brick Kilns functional with Consent to Operate 285

Finally, J & K Pollution Control Committee vide reference No.JKPCC/NGT/130/3030 dated 05.04.2024 furnished the complete status of brick kilns in the UT of Jammu and Kashmir and the same reproduced under:1. iv) Brick Kilns with Expired Consent to Establish 05 Closure orders and appended as annexure 365 Grand Total 570 Further, it is intimated that out of 365, closure orders in respect of the brick kilns which were operating without consent, 326 orders as per the reports of respective Regional Directors and Divisional Officers stands implemented. Remaining 39 brick kilns out of the brick kilns in respect of which closure orders have been in the first week of April 2024 are in the process of implementation through the respective District Magistrates. However, it is learnt that no brick kiln is currently functional..."
f. In terms of the directions of the Hon'ble National Green Tribunal, it isrespectfully submitted that as brought out in the final report of the J&KPCC, out of a total of 570 Brick Kilns in the J&K, 203 have been given Consent to Operate, 2 56 have been given consent to Establish and closure orders have been by the J&K PCC in respect of balance 365, all of which have been reported to be currently non-functional. J&K PCC has been directed to ensure no violation occurs on ground regarding the functioning of the Brick Kilns.
VII Action taken for proper functioning of J&K Pollution Control Committee
a) The Law Officer of the JKPCC, while appearing virtually on behalf of the Member Secretary JKPCC before the Hon'ble National Green Tribunal on 2-2-2024, had, interalia, stated:
".....that Member Secretary, J&K PCC has been transferred and two Regional Officers have also been transferred. Therefore, for want of any competent officer he is appearing virtually representing J&KPCC....."
b) Based on the above submissions of the Law Officer of the JKPCC, the Hon'ble National Green Tribunal had observed:
".....This reflect sorry state of affairs showing that there is no responsible officeravailable in the J&K PCC....."
And had accordingly directed:
"....... Principal Secretary, Department of Environment, J&K requiring him to fileresponse disclosing action taken for proper functioning of J&K PCC...."
c) It is respectfully submitted that the above statement of Law Officer of the JKPCC, before the Hon'ble National Green Tribunal on 2.2.2024is factually incorrect and misleading.
d) While the then Member Secretary, J&K Pollution Control Committee was transferred vide Government Order No.31-JK(FST) of 2024 dated 31.01.2024 (copy attached as Annexure-VI), he handed over the charge of Member Secretary, J&K Pollution Control Committee to the Chairman, JKPCC only on 5/2/2024 (copy attached as Annexure-VII). Similarly, the two regional directors were also transferred in the same order, and their substitutes provided. They were also available on 2.2.2024, contrary to the submissions of the Law officer. The new Member Secretary, J&K Pollution Control Committee has also joined on 15.3.2024.
e) Therefore on 2.2.2024, when both the Member Secretary, J&K PCC and the Chairman, J&K PCC were available in the J&K PCC HQs, and the two regional directors in the field, the above statement of the Law Officer before the Hon'ble National Green Tribunal is factually incorrect and misleading. The transfer of officers cannot be or was never the reason for non-compliance of 57 the directions of the Hon'ble Tribunal by the J&K PCC, regarding the closure of the non-consented brick kilns. The Chairman, J&K PCC has separately been asked to explain/clarify these submissions of the Law Officer and as why neither theMember Secretary, J&K PCC nor the Chairman, J&K PCC were present before the Hon'ble National Green Tribunal on 2.2.2024, despite its directions. He hasalso been asked to explain the reasons for the repeated noncompliance andinordinate delay on the part of J&K PCC in complying with the directions ofthe Hon'ble Tribunal regarding the closure of the non-consented brick kilns.
f) As regards the directions of the Hon'ble National Green Tribunal for proper functioning of the J&K PCC it is respectfully submitted that all senior officers/officials of the J&K PCC are in place, as per details given in Annexure-IX. Recently, transfers of all senior officers have also been affected in the J&K PCC after a gap of 5 years. A copy of the order is attached at Annexure-X. An exercise for reorganization and revision of the Recruitment Rules of the J&K PCC has also been initiated, about six months back, to professionalize the organization.
VIII) Accordingly, compliance report on the above lines was forwarded to the Consultant Judicial, Hon'ble National Green Tribunal vide letter No.FST-Lit/170/2022(7053120) dated 06.04.2024 with the request to place the same before the Hon'ble Tribunal, for its consideration (Copy attached as Annexure-XI).
IX) However, the case was subsequently listed for hearing on 08.04.2024 and the Hon'ble National Green Tribunal passed the following orders:
"1. Vide order dated 02.02.2024 notice to the Principal Secretary, Department of Environment, J & K requiring him to file response disclosing action taken for proper functioning of J & K PCC and also action taken against the brick kilns which have been set up and are operating without CTE/CTO and without, following environmental norms.
2. No response has been filed by the Principal Secretary, Department of Environment, J & K.
3. Report regarding compliance status of all brick kilns in the UT of J & K has been filed by the Member Secretary, J & KPCC vide email dated 06.04.2024.
4. Mr. Vasu Yadav, Chariman and Mr. Ghanshyam Singh, Member Secretary, JKPCC have appeared before this Tribunal through VC and we have interacted with them.58
5. Response be filed by the Principal Secretary, Department of Environment, J & K at least one week before the next date of hearing by e-mail at [email protected] preferably in the form of searchable PDF/OCR Support PDF and not in the form of Image PDF.
6. In the eventuality of not filing of such response within the above mentioned period, the Principal Secretary, Department of Environment, J & K shall attend this Tribunal physically on the date hereby fixed to explain the reasons for not filing of such response.
7. List for further consideration on 21.05.2024.
8. In view of the facts and circumstances of the case we also consider presence of the Member Secretary, J& K PCC through VC before this Tribunal on the next date of hearing to be essential for assisting this Tribunal in just and proper adjudication of the questions involved in the case. Accordingly he is directed to remain present before this Tribunal on that date with the relevant record.
9. A copy of this order be also sent to the Principal Secretary, Department of Environment, J & K and the Member Secretary, J & KPCC by email for requisite compliance."
X)As already stated above, compliance report on behalf of Principal Secretary to Government, Forest Department was already e-mailed to the Consultant Judicial, Hon'ble NGT on 06.04.2024 i.e., prior to the date of hearing fixed on 08.04.2024, for placing the same before the Hon'ble Tribunal. A copy of e-mail dated 06.04.2024, is enclosed herewith as Annexure-XII.
XI) Further, in compliance with the aforesaid direction of the Hon'ble National Green Tribunal passed on 08.04.2024, Member Secretary, J & K Pollution Control Committee vide reference No.JKPCC/NGT/130/3192 dated 06.05.2024 has furnished a brief note on the status of functioning of J& K Pollution Control Committee (Copy attached at Annexure-XIII).
23. The above material was considered by Tribunal on 21.05.2024 when Member Secretary, JKPCC was also present through virtual mode and had stated that 21 brick kilns were operating illegally despite closure orders and action was proposed to be taken against those brick kilns.
Consequently, Tribunal impleaded following 21 brick kilns as respondents 5 to 25 and issued notices to them giving them opportunity to file their response within one week before next date:

It is further said that JKPCC had issued notices to 21 defaulting brick kilns vide letter dated 03.08.2024 to show cause as to why Environmental Compensation as proposed above be not levied upon them. Since none of the defaulting brick kiln submitted reply to show cause notices, final orders were passed on 17.08.2024 in respect of 21 default brick kilns finalizing Environmental Compensation as mentioned in show cause notice. Copies of final orders dated 17.08.2024 have been appended to compliance report as annexure 2 to 22.
6226. It is further said that for verification of current status of implementation of directions issued by Tribunal on 14.07.2024, Regional Director JKPCC, Kashmir was required to conduct site inspections and provide current status. Vide letter dated 05.08.2024, Regional Director had informed that 134 brick kilns located in 3 districts namely; Badgam, Anantnag and Kulgam have started operations in violation of Tribunal's order as also closure order issued by JKPCC and break-up of brick kilns in 3 districts is given as under:-

28. Details of the above defaulting brick kilns who have resumed operations without valid consent and in violation of closure orders have been shared with Divisional Commissioner, Kashmir vide JKPCC DO letter dated 06.08.2024 with the request to ensure enforcement of closure orders of JKPCC and directions of Tribunal. Regional Director, JKPCC Kashmir and also Divisional Officers were also directed to file complaints against defaulting brick kilns with the concerned Magistrates having jurisdiction in the matter under provisions of Water (Prevention and Control of Pollution) Act, 1974 and Air (Prevention and Control of Pollution) Act, 1981. Till submission of the report, it is said that 20 such complaints were filed with respective Courts and with respect to others, steps are being taken.
29. On 23.08.2024 when matter was taken up, Sh. Vishal Goel, Advocate had appeared on behalf of respondents 5 to 25 and sought time to file response which was granted. JKPCC was also directed to provide 67 status of imposition of Environmental Compensation, etc. and verification of current status by submitting a report.
30. No reply has been filed on behalf of respondent 5 to 25 till date.
However, compliance report dated 30.09.2024 has been filed by Member Secretary, JKPCC which states that some brick kiln owners have approached J&K and Ladakh High Court by filing Writ Petitions wherein various orders have been passed and a detailed chart given in this respect regarding 17 brick kiln units is as under:-

5. M/s Sri Ganesh WP (c) Order dated 20-05-2025 5 Kiln, Kangrail No.1114/2024 Dayaran, Jammu "Meanwhile, subject to objections and till next date before the Bench, it is ordered that in case a representation has been made by the petitioner to the respondents, the same shall be disposed of by them and tilt the representation of the petitioner is considered and decided, the respondents shall not take any coercive measures against the petitioner.

6. M/s Kaitash pati WP (c) Order dated 07-06-2024 6 Brick Kiln, New No.1375/2024 Bawa Tatab, "In the meantime, the Jammu. respondents are directed to consider the renewal of last consent to operate of the petitioner without insisting upon the conversion to the prescribed technology and the unit of the petitioner shall not be subjected to any forced closure. This interim direction is, however, subject to objections from the other side".

"Meanwhile, the respondents are directed to consider the renewal of petitioner's Pollution Control Certificate at least up to 23.02.2025 without insisting upon conversion of its brick kiln to Zig Zag Technology or Vertical Shaft Technology or Piped Natural Gas. Till such time the decision is taken by the respondents on the representation of the petitioner, no coercive measure shall be taken against the petitioner".

17. M/s Vaid Brick WP (c) Order dated 22-05-2024 17 Kiln, Rakh Baroi, No.1139/2024 Samba "Meanwhile, the respondents are directed to consider the renewal of petitioner's Pollution Control Certificate at least up to 23.02.2025 without insisting upon conversion of its brick kiln to Zig Zag Technology or Vertical Shaft Technology or Piped Natural Gas. Till such time the decision is taken by the respondents on the representation of the 72 petitioner, no coercive measure shall be taken against the petitioners".
31. It is said that in respect of 4 brick kiln units, no orders have been received from the High Court and details of these brick kiln units are as under:-

32. It is further said that against imposition of Environmental Compensation upon 21 brick kilns, 5 have filed Writ Petition in the High Court of Jammu, Kashmir and Ladakh under the challenging Environmental Competition wherein interim orders have been passed.

M/s Vaid Brick WP (c) consider the renewal of Kiln, Rakh Baroi, No.2309/2024 petitioners' Pollution Samba Control Certificate at least up to 23.02.2025 without insisting upon conversion of its brick kiln to Zig Zag Technology or Vertical Shaft Technology or Piped Natural Gas, until the decision is taken by the respondents on the representation of the petitioners, no coercive measures shall be taken against the petitioners".
33. Today none has appeared on behalf of respondent 5 to 25.
34. Member Secretary, JKPCC who is present in virtual mode has stated that in cases wherein interim protection has been provided by High Court it has to wait for final orders to be passed by High Court and in other matters, steps are being taken for enforcement of closure orders already passed, if any, and if not, by taking steps for passing further orders and for realization of Environmental Compensation and also to ensure compliance of the closure orders by requesting Deputy Commissioner concerned by issuing directions.
35. In this backdrop we find that no useful purpose would not be served by keeping this matter pending. Hence, we propose to dispose this Original Application by issuing following directions:-
74i. In respect of 21 brick kilns which are impleaded as respondents 5 to 25 where final orders have been passed by High court and thereafter JKPCC has also complied with directions issued by High court, further steps in accordance with law shall be taken to enforce environmental laws against concerned brick kiln units.
ii. In respect of brick kiln units wherein no Writ Petition has been filed in High court and/ no interim order has been passed, JKPCC shall proceed to take steps for enforcement of environmental laws against such brick kilns and ensure that such brick kilns are not allowed to operate without compliance with environmental laws.
iii. In respect of 134 brick kiln units in Kashmir which have resumed operations despite closure orders, we direct concerned Deputy Commissioner to ensure compliance of closure orders by taking all requisite steps in accordance with law, in consultation and coordination of JKPCC, and submit a compliance report within two months to Registrar General of this Tribunal.
36. We make it clear that if in any of the above matters, any matter has been filed in High Court and there is an order otherwise, the same shall prevail the above directions issued by this Tribunal and in such matters High Court's order shall govern those cases.
37. With regard to compliance of directions contained in i and ii above, Member Secretary, JKPCC shall also file a compliance report by 15.01.2025.
7538. Registrar General, if finds that any further order is required, shall place the matter before Bench concerned.
39. With the above direction, Original Application is disposed of.
