                                     ORDER

1. The appellant filed an application under the Right to Information Act, 2005 (RTI Act) before the Central Public Information Officer (CPIO), State Bank of India (formerly State Bank of Mysore), Regional Office-IV, Mandya, seeking information on eleven points pertaining to the charge sheet issued to him, including, inter alia, (i) a copy of his letter dated 15.02.2017 addressed to the bank, (ii) a copy of the reply submitted by him to the charge sheet, and (iii) copies of Day Book Tally records pertaining to letters dated 07.06.2006, 08.06.2006, 09.06.2006, 28.06.2006, 29.06.2006, 30.06.2006 and 01.07.2006 mentioned in the charge sheet.

2. The appellant filed a second appeal before the Commission on the grounds that no information has been provided to him by the CPIO. Further, the FAA also did not replied to his first appeal. The appellant requested the Commission to direct the CPIO to provide the information sought for by him free of cost, to impose a penalty on the CPIO as per the RTI Act, to recommend disciplinary action against the CPIO as per the provisions of the RTI Act, and to award him compensation.

3. The appellant Shri M. Krishna and the respondent Shri P.R. Desai, Chief Manager, State Bank of India, Mysore Zone attended the hearing through video conferencing.

4. The appellant submitted that no information has been provided to him in response to his RTI application dated 08.10.2015. The appellant further submitted that his first appeal dated 26.03.2015 has also not been disposed of by the FAA.

The respondent submitted that the appellant was informed vide letter dated 15.10.2015 that his RTI application has been transferred to the CPIO and AGM, State Bank of Mysore, Mysore Zone, Region-IV, Mandya, as the subject matter pertains to them. However, the respondent could not clarify as to why the RTI application was transferred to the CPIO, State Bank of Mysore, Mysore Zone, Region-IV, Mandya when the appellant had filed the RTI application with the CPIO, State Bank of Mysore, Mysore Zone, Region-IV, Mandya.

Decision:

The Commission, after hearing the submissions of both the parties and perusing the records, notes that no reply has been furnished by the respondent in response to the appellant's RTI application dated 08.10.2015. The Commission, therefore, directs the Registry of this Bench to issue a Show Cause Notice to the CPIO, State Bank of Mysore, Mysore Zone, Region-IV, Mandya for explaining as to why action under Section 20(1) of the RTI Act should not be initiated against him.

7. The Commission also directs the CPIO, State Bank of Mysore, Mysore Zone, Region-IV, Mandya to provide information, as per the provisions of the RTI Act, to the appellant within a period of four weeks from the date of receipt of a copy of this order.

8. With the above observations, the appeal is disposed of.
